【摘要】：導語數(shù)量與潛力巨大的公共部門數(shù)據(jù)及信息資源的再利用問題是目前各國政府及產(chǎn)業(yè)界高度關(guān)注的熱點,歐盟、英國、美國、加拿大、澳大利亞等地區(qū)和國家紛紛出臺針對性的政策法律文件及進行相關(guān)的制度設計,積極推進公共部門原始數(shù)據(jù)與信息的全社會再利用,以創(chuàng)造更加多樣化的服務業(yè)態(tài)和產(chǎn)品形式,提供更加豐富的信息消費選擇,并創(chuàng)造更多的就業(yè)機會、增進社會福祉。2004年12月13日,中共中央辦公廳、國務院辦公廳《關(guān)于加強信息資源開發(fā)利用工作的若干意見》(簡稱34號文件)首次在國家文件中提出了政務信息資源社會化增值開發(fā)利用問題,為我國信息再利用提供了政策指南框架。但相關(guān)的制度體系及法律規(guī)范還不夠明晰,信息再利用的學術(shù)研究規(guī)模和深度也還有較大的局限。武漢大學陳傳夫教授主持的國家社會科學基金重大項目"我國公共部門信息資源增值利用的對策研究"(編號:09ZD039)及其研究團隊,對發(fā)達國家和地區(qū)信息資源增值利用的情況與趨勢、我國信息資源增值利用的用戶定位與企業(yè)定位、公共部門信息再利用制度構(gòu)建、個人信息保護等問題進行了系統(tǒng)研究,已經(jīng)取得了較為豐碩的科研成果,然而有關(guān)信息再利用中的利益分配、經(jīng)濟效益擴大化、信息質(zhì)量標準、法律規(guī)則、商業(yè)模式、集成整合、機制創(chuàng)新等方面的研究尚可進一步拓展。作為上述項目子課題的承擔者,本專題我們組織了3篇文章,分別從利益分配、經(jīng)濟效益、法律規(guī)范角度深入探討了公共部門信息再利用問題。其一,系統(tǒng)地研究我國公共部門信息資源增值利用中的利益分配機制。認為我國公共部門信息資源增值利用過程中存在利益分配不均衡的問題,公共部門信息資源壟斷較為嚴重。公共部門信息資源增值利用的開發(fā)主體可劃分為責任主體(公共部門)、利益主體(企業(yè))及義務主體(第三部門)。通過分析上述開發(fā)主體的利益關(guān)系,借鑒國外公共部門信息資源增值利用的經(jīng)驗,明確我國應該盡快構(gòu)建公共部門信息資源增值利用的利益分配機制、明細利益分配的目標和原則、構(gòu)建利益分配機制的監(jiān)督體系。其二,探索擴大公共部門信息再利用中的經(jīng)濟效益問題。從經(jīng)濟效益視角出發(fā),展開對公共部門信息再利用問題的研究,闡述相關(guān)概念及研究范疇,分析發(fā)達國家公共部門信息再利用經(jīng)濟效益的獲取路徑,并在此基礎上對我國擴大公共部門信息再利用經(jīng)濟效益提出改進建議。其三,分析公共部門信息再利用中的法律規(guī)則。認為公共部門信息的價值巨大,其再利用活動受到信息自由法、信息和通信技術(shù)法、知識產(chǎn)權(quán)法和競爭法的影響,這些法律制度為公共部門信息再利用提供了相應規(guī)則,能較好地平衡各方利益,有效地促進公共部門信息再利用活動的開展。本專題研究試圖豐富整個重大項目的研究視角和研究內(nèi)涵,推進我國公共部門信息資源再利用體系建設及實踐發(fā)展。
[Abstract]:The number and the huge potential of the public sector data and information resource utilization problem is currently high attention of governments and industry hot spots, the European Union, Britain, America, Canada, Australia and other countries and regions have introduced policies for the design of the system of legal documents and associated, and actively promote the public sector and raw data the information of the whole society to use, to create a more diverse service format and product form, provide information on consumer choice more abundant, and create more employment opportunities, increase social welfare.2004 in December 13th, general office of the CPC Central Committee, the general office of the State Council "on the strengthening of information resources development and utilization of the work of a number of opinions (referred to as No. 34 for the first time in the national document file) is proposed in the e-government information resources development and utilization of social value, provide policy guidance for China's information reuse Frame. But the system and relevant legal norms is not clear, the academic information reuse research scale and depth also have greater limitations. Countermeasures of information resource in China's public sector by the major national social science fund project of Wuhan University professor Chen Chuanfu "(No. 09ZD039) and the research team, and the trend of value of information resources in developed countries and regions using, user location and positioning of the enterprise information resource utilization in China, re use of public sector information system construction, the system of personal information protection, has made fruitful achievements in scientific research, but the relevant information by the distribution of benefits, economic benefits the expansion, information quality standards, rules of law, business model, integration, innovation and other aspects of the mechanism research can further expand the. Project undertaker, the topic we organized 3 articles, respectively from the distribution of benefits, economic benefits, legal norms and discusses problems of reuse of public sector information. A systematic study of information resource in China's public sector in the use of the interest distribution mechanism that information resources value-added in China. The public sector with unbalanced interest distribution problems in the process of public sector information resource monopoly is more serious. The development of the main public sector information resource utilization can be divided into the main responsibility (public sector), benefit main body (enterprise) and obligations (third departments). Through the analysis of the development of the main interests, reference the value of overseas use of public sector information resources experience, our country should be clear as soon as possible to construct the interest distribution mechanism of value-added use of public sector information resources, the purpose of profit distribution list Standard and principle of system construction, supervision mechanism of interest distribution. Second, to explore the expansion of reuse of public sector information economic problems. Starting from the economic perspective, the research issues of reuse of public sector information, this category of related concepts and research, analysis of the public sector in developed countries to obtain information reuse path of economic benefits and, on the basis of our country to expand the reuse of public sector information economic analysis and put forward the improvement proposal. Third, re use of public sector information in the legal rule. That huge public sector information value, the reuse of activities by the freedom of Information Act, information and communication technology, effect of intellectual property law and competition law the legal system, provide the corresponding rules for the reuse of public sector information, can better balance the interests of all parties, effectively promote the reuse of public sector information. The theme of this research is to enrich the research perspective and research content of the major project, and to promote the construction and practice development of public sector information resources re-use system in China.
