基于專利分析的數(shù)字版權(quán)保護技術(shù)發(fā)展趨勢研究

【摘要】:隨著信息技術(shù)和計算機技術(shù)的快速發(fā)展,傳統(tǒng)書籍、音像制品等內(nèi)容的數(shù)字化成為新的發(fā)展潮流和方向,然而網(wǎng)絡(luò)的分享與自由性使得此類數(shù)字化的內(nèi)容變得易于得到且能夠快速傳播,引發(fā)了十分嚴重的版權(quán)與產(chǎn)權(quán)問題,侵害了數(shù)字版權(quán)所有者的利益。數(shù)字版權(quán)保護技術(shù)逐漸成為人們保護自身權(quán)益的一種重要手段。專利最能反映技術(shù)的發(fā)展變遷,其覆蓋范圍全面,包含內(nèi)容準確。通過對數(shù)字版權(quán)保護技術(shù)領(lǐng)域相關(guān)專利的檢索和分析,研究該技術(shù)領(lǐng)域的發(fā)展過程、研發(fā)側(cè)重點及發(fā)展趨勢,為企業(yè)或高校的研發(fā)戰(zhàn)略提供參考。本文從三個層面,即專利管理、專利權(quán)利和專利技術(shù),系統(tǒng)地提出了一種技術(shù)發(fā)展趨勢的分析模型框架,多層次、多角度地分析數(shù)字版權(quán)保護技術(shù)發(fā)展的趨勢。通過對國內(nèi)外現(xiàn)有的理論研究文獻進行回顧、梳理和分析,嚴格遵循專利分析的一般流程,對1991-2015年這一時間內(nèi)的數(shù)字版權(quán)保護技術(shù)的相關(guān)專利進行檢索。在專利管理層面對申請數(shù)量等指標進行了分析,從中了解我國數(shù)字版權(quán)保護技術(shù)領(lǐng)域的發(fā)展態(tài)勢和主要的技術(shù)領(lǐng)域,以及企業(yè)研發(fā)中潛在的競爭情況。在專利權(quán)利層面從專利法律狀態(tài)和專利壽命兩個方面進行了分析,了解某件專利是否授權(quán),授權(quán)專利是否有效等相關(guān)信息。專利壽命分析可用來發(fā)現(xiàn)哪項技術(shù)是品質(zhì)較好的基礎(chǔ)性技術(shù)或核心技術(shù)。在專利技術(shù)層面從技術(shù)功效和技術(shù)生命周期兩個方面進行了分析,其中技術(shù)功效分析通過構(gòu)建功能/效果矩陣,可以發(fā)現(xiàn)當前版權(quán)保護技術(shù)領(lǐng)域中的技術(shù)熱點和技術(shù)空白,指導(dǎo)企業(yè)的研發(fā)。技術(shù)生命周期按照周期規(guī)律分析技術(shù)發(fā)展的總體狀況及當前技術(shù)水平所處階段。通過以上三個層面的研究發(fā)現(xiàn)當前中國數(shù)字版權(quán)保護技術(shù)發(fā)展到目前處于快速成長階段,在近期將維持增長趨勢,尤其在當今對知識產(chǎn)權(quán)保護加大的情況下;且發(fā)明人團隊化、規(guī);,高校逐漸成為技術(shù)研發(fā)的不可忽視的力量;數(shù)字版權(quán)保護技術(shù)從"限制"走向"保護",減少了對具體內(nèi)容的加密和限制,增加了對內(nèi)容標識的運用?偠灾,數(shù)字版權(quán)保護技術(shù)這一領(lǐng)域的專利還處在蓬勃發(fā)展中,可以預(yù)測在未來一段時間內(nèi),中國數(shù)字版權(quán)保護技術(shù)的專利申請仍將保持高速增長的趨勢。最后,根據(jù)本文的研究結(jié)論給政府和企業(yè)提出了針對性的建議。政府要進一步發(fā)揮自身作用,完善相關(guān)法律制度及網(wǎng)絡(luò)版權(quán)管理制度,及時發(fā)布專利地圖,引導(dǎo)專利研發(fā)方向。在競爭日益激烈的今天,企業(yè)要加大提高自主創(chuàng)新能力,提高專利申請的授權(quán)率;此外要加強對失效專利的利用,并及時追蹤競爭對手,制定自己的研發(fā)戰(zhàn)略。
[Abstract]:With the rapid development of information technology and computer technology, the digitalization of traditional books, audio-visual products and other contents has become a new trend and direction of development. However, the sharing and freedom of the network make this kind of digital content easily available and can be spread quickly, causing serious copyright and property rights problems. The technology of digital copyright protection has gradually become an important means for people to protect their own rights and interests. Through the retrieval and analysis of the relevant patents in the field of digital copyright protection technology, the development process, research and development focus and development trend of the technology field are studied. This paper systematically puts forward an analytical model framework of technology development trend from three aspects, namely patent management, patent rights and patent technology. The development trend of digital copyright protection technology is analyzed from many angles. Through reviewing, combing and analyzing the existing theoretical research literature at home and abroad, we strictly follow the general process of patent analysis. The relevant patents of digital copyright protection technology in the period 1991-2015 were searched and analyzed in the face of the number of applications filed by the patent management. From this point of view, we can find out the development trend and main technical fields of digital copyright protection technology in China, as well as the potential competition in R & D of enterprises. In the aspect of patent rights, this paper analyzes the legal status of patents and the patent lifetime. To know if a patent is authorized, Patent life analysis can be used to find out which technology is the basic technology or core technology of good quality. At the level of patent technology, it is analyzed from two aspects: technical efficacy and technology life cycle. By constructing the function / effect matrix, the technical efficacy analysis can find the technical hot spots and technical gaps in the field of copyright protection technology. To guide the research and development of enterprises. The technology life cycle according to the cycle law analysis of the overall status of technology development and the current level of technology. Through the above three levels of research found the current development of digital rights protection technology in China. Up to now, at the stage of rapid growth, In the near future, it will maintain the trend of growth, especially under the circumstance of increasing the protection of intellectual property, and the inventors' team, scale, universities and colleges will gradually become the force that can not be ignored in the research and development of technology. Digital copyright protection technology has changed from "restriction" to "protection", which has reduced the encryption and restriction of specific content and increased the use of content identification. In a word, the patent of digital copyright protection technology is still booming. It can be predicted that patent applications for digital copyright protection technologies in China will continue to grow at a high speed in the near future. Finally, According to the conclusion of this paper, some suggestions are put forward to the government and enterprises. The government should give full play to its own role, perfect the relevant legal system and network copyright management system, and issue the patent map in time. Guide the direction of patent research and development. In today's increasingly competitive era, enterprises should increase their ability to improve independent innovation and increase the licensing rate of patent applications; in addition, they should strengthen the use of invalid patents and track competitors in a timely manner. Develop your own R & D strategy.
