【摘要】：植物新品種權(quán)是指國家機關(guān)依照法律法規(guī)的規(guī)定,賦予品種權(quán)人對其新種享有的經(jīng)濟權(quán)利和精神權(quán)利的總稱。我國植物新品種保護制度建立于1997年,并于1999年加入國際植物新品種保護聯(lián)盟,自此我國的植物新品種保護取得了偉大的成就,植物新品種的申請量也表現(xiàn)出逐年上升的趨勢。但是,植物新品種權(quán)的誕生伴隨著侵權(quán),而且隨著植物新品種在經(jīng)濟發(fā)展中的作用越來越明顯,這種侵權(quán)現(xiàn)象也越來越多。由于我國目前對植物新品種的保護還處于初步探索階段,《植物新品種保護條例》的相關(guān)規(guī)定也比較籠統(tǒng),缺乏具體規(guī)定,可操作性差。 本文從植物新品種權(quán)保護的基本理論入手,運用查閱文獻、比較研究、實證分析等方法,比較研究了外國對植物新品種權(quán)的保護,并介紹了我國對植物新品種權(quán)的保護現(xiàn)狀及存在的問題,進而對我國植物新品種權(quán)制度提出完善的建議。本文主體共分為四大部分,第一部分,闡述了植物新品種權(quán)的基本理論,認為植物新品種權(quán)是一種類似于專利權(quán)的知識產(chǎn)權(quán),但是它又有獨特的法律特征和特定的內(nèi)容,是一項獨立的知識產(chǎn)權(quán)；第二部分,比較法考察了國際社會UPOV公約、《與貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)議》以及美國、歐盟等不同國家對植物新品種權(quán)的保護制度,對比我國的植物新品種保護機制,以期找到對我國有借鑒意義的保護方式；第三部分,主要闡述了植物新品種權(quán)侵權(quán)的認定、侵權(quán)的抗辯事由；第四部分,分析并指出我國植物新品種權(quán)保護在發(fā)展中存在的問題,對我國植物新品種權(quán)保護制度提出合理化的建議,如立法的完善、行政保護機制的完善、司法保護機制的完善以及制種大戶是否承擔責(zé)任的問題。
[Abstract]:The new plant variety right refers to the economic and spiritual rights granted to the variety owner by the state organs according to the laws and regulations. The protection system of the new plant variety in China was established in 1997. And joined the International Union for the Protection of New varieties of plants in 1999. Since then, great achievements have been made in the protection of new varieties of plants in China, and the number of applications for new varieties of plants has also shown a trend of increasing year by year. The birth of new plant variety rights is accompanied by infringement, and as the role of new plant varieties in economic development becomes more and more obvious, Since the protection of new plant varieties in China is still in the initial stage of exploration, the relevant provisions of the regulations on the Protection of New Plant varieties are also relatively general, lacking of specific provisions, and poor maneuverability. Starting with the basic theory of the protection of new plant variety rights, this paper compares and studies the protection of new plant variety rights in foreign countries by means of consulting literature, comparative research, empirical analysis, etc. The paper also introduces the present situation and existing problems of the protection of new plant variety rights in China, and then puts forward some suggestions to perfect the system of new plant variety rights in China. The main body of this paper is divided into four parts, the first part, This paper expounds the basic theory of plant new variety right, and holds that plant new variety right is a kind of intellectual property similar to patent right, but it has unique legal characteristics and specific contents, so it is an independent intellectual property right. The comparative law has examined the UPOV convention of the international community, the Agreement on Trade-Related aspects of intellectual property Rights (trips Agreement), and the protection system of new plant varieties in different countries, such as the United States and the European Union, and compared the protection mechanisms of new plant varieties in China. In order to find the protection method of reference to our country; the third part, mainly elaborated the plant new variety right infringement confirmation, the infringement defense reason; the fourth part, This paper analyzes and points out the problems existing in the development of the protection of new plant variety rights in China, and puts forward some reasonable suggestions for the protection system of new plant variety rights in China, such as the perfection of legislation and the perfection of administrative protection mechanism. The perfection of the judicial protection mechanism and the question of whether the big seed producers bear the responsibility.
