【摘要】：隨著媒介融合不斷向縱深推進(jìn),新聞資訊侵權(quán)現(xiàn)象愈發(fā)嚴(yán)重,產(chǎn)權(quán)保護(hù)正陷入"囚徒困境",面臨嚴(yán)峻挑戰(zhàn),中外概莫能外。當(dāng)前我國(guó)新聞資訊產(chǎn)權(quán)保護(hù)已陷入法律法規(guī)滯后、行政監(jiān)管乏力、媒體呼吁無(wú)力以及第三方維權(quán)尷尬的困境。針對(duì)當(dāng)下這些現(xiàn)象和問(wèn)題,從國(guó)外新聞資訊維權(quán)成功的經(jīng)驗(yàn)和做法來(lái)看,我國(guó)新聞資訊產(chǎn)權(quán)保護(hù)應(yīng)盡快完善產(chǎn)權(quán)保護(hù)機(jī)制,健全司法保護(hù)體制,切實(shí)提高各參與方的版權(quán)意識(shí),構(gòu)建合作共贏機(jī)制,還可嘗試組建媒體維權(quán)聯(lián)盟共同維權(quán),并積極參與國(guó)際交流與合作。
[Abstract]:With the development of media integration, the phenomenon of news and information infringement is becoming more and more serious, and the protection of property rights is in the "prisoner's dilemma", which is facing severe challenges and can not be excluded. At present, the protection of the property rights of news and information in our country has fallen into the lag of laws and regulations. Administrative supervision is weak, media appeals are weak, and third parties are embarrassed about defending their rights. In view of these phenomena and problems, from the successful experience and practice of foreign news and information rights protection, The protection of news and information property rights in China should improve the mechanism of property rights protection as soon as possible, perfect the system of judicial protection, improve the copyright awareness of all participants, build a win-win mechanism for cooperation, and try to form a joint media alliance to safeguard rights. And actively participate in international exchanges and cooperation.
