【摘要】：刑法是保護網(wǎng)絡(luò)版權(quán)的最后手段,也是保護知識產(chǎn)權(quán)的堅強后盾。面對網(wǎng)絡(luò)版權(quán)保護的難題,刑法及司法實踐應(yīng)樹立版權(quán)優(yōu)位和預(yù)防優(yōu)先的理念,創(chuàng)新網(wǎng)絡(luò)版權(quán)的刑法治理模式。同時,暢通網(wǎng)絡(luò)版權(quán)的行政執(zhí)法與刑事司法的銜接,保證刑法與知識產(chǎn)權(quán)法規(guī)、網(wǎng)絡(luò)法規(guī)的協(xié)調(diào),形成體系化的保護規(guī)范;也要有針對性地運用刑罰和非刑罰措施懲治網(wǎng)絡(luò)版權(quán)犯罪,懲處網(wǎng)絡(luò)版權(quán)邊緣關(guān)聯(lián)犯罪,使網(wǎng)絡(luò)版權(quán)犯罪治理更加嚴密有效,形成全面懲治、精準打擊的保護體系。
[Abstract]:The criminal law is the last means of network copyright protection, the protection of intellectual property rights is the strong backing. Facing the problem of network copyright protection, criminal law and judicial practice should establish copyright priority and prevent the priority of the concept of innovation network governance model of criminal law copyright. At the same time, the smooth flow of network copyright administrative law enforcement and criminal justice cohesion, guarantee of criminal law with intellectual property rules, coordination network regulations, forming a protective system of norms; also should be targeted to the use of penalty and non penalty measures against network copyright crime, punish network copyright edge related crimes, the crime of network copyright governance more effective, form a comprehensive protection system of punishment, precision strike.
