【摘要】:隨著貨物貿(mào)易、服務(wù)貿(mào)易在全球范圍內(nèi)展開合作,知識(shí)產(chǎn)權(quán)保護(hù)的國(guó)際合作也成為國(guó)際經(jīng)濟(jì)領(lǐng)域的重要合作內(nèi)容。TRIPS協(xié)定中有很多為照顧發(fā)展中國(guó)家利益而規(guī)定的彈性條款,而近年來,,發(fā)達(dá)國(guó)家不滿足TRIPS協(xié)定規(guī)定的知識(shí)產(chǎn)權(quán)保護(hù)水平,想通過各種方法提高知識(shí)產(chǎn)權(quán)保護(hù)水平。由于多哈回合談判的停滯不前,發(fā)達(dá)國(guó)家將自由貿(mào)易協(xié)定作為其推行“超TRIPS”條款的主要方式,給經(jīng)濟(jì)發(fā)展和知識(shí)產(chǎn)權(quán)保護(hù)水平差異很大的發(fā)展中國(guó)家?guī)砗芏鄩毫ΑV袊?guó)是TRIPS協(xié)定下最大的發(fā)展中國(guó)家,當(dāng)下簽訂的FTAs中知識(shí)產(chǎn)權(quán)條款存在很多問題,知識(shí)產(chǎn)權(quán)自由貿(mào)易協(xié)定戰(zhàn)略安排體系也比較薄弱,不足以應(yīng)對(duì)當(dāng)下發(fā)達(dá)國(guó)家強(qiáng)勢(shì)的“超TRIPS”規(guī)則。本文即以TRIPS協(xié)定為基礎(chǔ),對(duì)中國(guó)FTAs知識(shí)產(chǎn)權(quán)條款存在的問題以及新出現(xiàn)的“超TRIPS”條款展開研究,為中國(guó)日后簽訂FTA知識(shí)產(chǎn)權(quán)規(guī)則提供借鑒意義。 文章分為以下六個(gè)部分: 第一部分是關(guān)于中國(guó)FTAs知識(shí)產(chǎn)權(quán)條款的概述。文章采用歷史分析方法、比較分析方法,梳理了中國(guó)當(dāng)下簽訂的7個(gè)包含知識(shí)產(chǎn)權(quán)條款的自由貿(mào)易協(xié)定的規(guī)定情況,對(duì)每個(gè)FTA知識(shí)產(chǎn)權(quán)條款內(nèi)容做了簡(jiǎn)要介紹,并提出本文研究的的命題。 第二部分分析了中國(guó)FTAs知識(shí)產(chǎn)權(quán)總則條款。運(yùn)用比較分析和綜合分析的方法,將中國(guó)FTAs知識(shí)產(chǎn)權(quán)總則條款與TRIPS協(xié)定的總則條款進(jìn)行對(duì)比,發(fā)現(xiàn)其在結(jié)構(gòu)和內(nèi)容上存在的問題,并加以分析。 第三部分對(duì)中國(guó)FTAs知識(shí)產(chǎn)權(quán)實(shí)體性條款進(jìn)行分析。該部分先梳理了中國(guó)FTAs中知識(shí)產(chǎn)權(quán)實(shí)體性條款的規(guī)定情況,并選取遺傳資源、傳統(tǒng)知識(shí)和民間文藝保護(hù)條款、版權(quán)及相關(guān)權(quán)利保護(hù)條款、未披露信息保護(hù)條款為代表性條款進(jìn)行深入分析。 第四部分對(duì)中國(guó)FTAs知識(shí)產(chǎn)權(quán)程序性條款進(jìn)行分析。該部分選取爭(zhēng)端解決條款和知識(shí)產(chǎn)權(quán)執(zhí)法條款為分析對(duì)象,找出與TRIPS協(xié)定規(guī)定不一致之處,并分析執(zhí)法部分“超TRIPS”條款對(duì)我國(guó)執(zhí)法機(jī)構(gòu)帶來的不利影響,以及爭(zhēng)端解決機(jī)制存在的問題。 第五部分總結(jié)分析了中國(guó)FTAs知識(shí)產(chǎn)權(quán)條款存在的問題。該部分在前述條款論述的基礎(chǔ)上總結(jié)出中國(guó)FTAs知識(shí)產(chǎn)權(quán)條款存在的整體性問題,主要有未形成范本模式,表述不夠嚴(yán)謹(jǐn),協(xié)定內(nèi)部某些條款缺乏協(xié)調(diào)性等。 第六部分論述了對(duì)我國(guó)FTAs知識(shí)產(chǎn)權(quán)條款的完善研究。該部分針對(duì)前述分析中國(guó)FTAs知識(shí)產(chǎn)權(quán)條款存在的問題,對(duì)我國(guó)日后簽訂FTA知識(shí)產(chǎn)權(quán)條款應(yīng)對(duì)“超TRIPS”規(guī)則提供對(duì)策建議。 結(jié)語部分對(duì)全文進(jìn)行總結(jié)。
[Abstract]:With the trade in goods and trade in services, the international cooperation in the protection of intellectual property rights has become an important part of international economic cooperation. The trips Agreement has many flexible provisions to cater for the interests of developing countries. In recent years, however, developed countries have failed to meet the level of intellectual property protection stipulated in the TRIPS Agreement and have sought to raise the level of intellectual property protection by various means. Developed countries regard free trade agreements as their main way of carrying out the "super TRIPS" clause, which brings a lot of pressure to developing countries whose economic development and intellectual property protection level are very different. China is the largest developing country under the TRIPS Agreement. There are many problems in the intellectual property provisions in the current FTAs, and the strategic arrangement system of the intellectual property Free Trade Agreement is also relatively weak, which is not sufficient to deal with the "super TRIPS" rules of the developed countries. This paper is based on the TRIPS Agreement. This paper studies the problems existing in the intellectual property provisions of China's FTAs and the new "super TRIPS" clauses, which provide a reference for China to sign the FTA intellectual property rules in the future. The article is divided into the following six parts:. The first part is an overview of the intellectual property provisions of China's FTAs. The article uses the historical analysis method, comparative analysis method, combing the current China signed seven free trade agreements containing intellectual property provisions of the provisions. The content of each FTA intellectual property clause is briefly introduced, and the proposition studied in this paper is put forward. The second part analyzes the general provisions of China's FTAs intellectual property rights. By means of comparative analysis and comprehensive analysis, the article compares the general provisions of China's FTAs intellectual property rights with those of the TRIPS Agreement, and finds out the problems existing in its structure and content. And analyze it. The third part analyzes the substantive provisions of intellectual property rights in China's FTAs. This part first combs the provisions of the substantive provisions of intellectual property rights in China's FTAs, and selects genetic resources, traditional knowledge and folk literature and art protection provisions. Copyright and related rights protection provisions, undisclosed information protection provisions for representative provisions for in-depth analysis. Part 4th analyzes the procedural provisions of intellectual property rights of FTAs in China. This part selects the dispute settlement clause and the enforcement clause of intellectual property as the object of analysis, and finds out the inconsistency with the provisions of the TRIPS Agreement. It also analyzes the adverse effects of the "super TRIPS" clause on the law enforcement agencies in China and the existing problems in the dispute settlement mechanism. Part 5th summarizes and analyzes the problems existing in the intellectual property provisions of FTAs in China. The expression is not strict enough, some provisions of the agreement lack coordination and so on. Part 6th discusses the improvement of the FTAs intellectual property provisions in China. This part analyzes the problems existing in China's FTAs intellectual property provisions, and provides countermeasures and suggestions for the future signing of FTA intellectual property provisions in China in accordance with the "super TRIPS" rules. The conclusion part summarizes the full text.
