【摘要】：植物新品種權(quán)是由我國(guó)農(nóng)林部等行政部門按照法律、法規(guī)的規(guī)定,賦予植物新品種育種人在一定期間內(nèi),對(duì)植物新品種所享有的一種具有獨(dú)占性質(zhì)的排他權(quán)利。品種權(quán)作為一種新型的知識(shí)產(chǎn)權(quán),日益受到國(guó)際社會(huì)的普遍關(guān)注和重視。我國(guó)已經(jīng)加入WTO,必須逐步履行包括知識(shí)產(chǎn)權(quán)在內(nèi)的國(guó)際貿(mào)易規(guī)則,然而我國(guó)在知識(shí)產(chǎn)權(quán)保護(hù)方面與trips協(xié)議還存在著較大的差距,植物新品種作為新型知識(shí)產(chǎn)權(quán)更是薄弱。作為一個(gè)農(nóng)業(yè)大國(guó),加強(qiáng)對(duì)植物新品種的知識(shí)產(chǎn)權(quán)保護(hù)對(duì)我國(guó)的農(nóng)業(yè)發(fā)展有著至關(guān)重要的作用。本文結(jié)合國(guó)際國(guó)外植物新品種保護(hù)現(xiàn)狀及我國(guó)植物新品種保護(hù)概況進(jìn)行研究,來(lái)探討我國(guó)植物新品種知識(shí)產(chǎn)權(quán)保護(hù)存在的問(wèn)題以及完善方法。 本文主要分為五個(gè)部分。 第一部分主要對(duì)植物新品種研究的背景、現(xiàn)狀、價(jià)值進(jìn)行了闡述。 第二部分主要介紹了植物新品種的概念,以目前國(guó)際上對(duì)植物新品種的保護(hù)模式的劃分,主要分為“單一型”保護(hù)模式和“復(fù)合型”保護(hù)模式。 第三部分主要介紹了UPOV公約的制定以及相關(guān)規(guī)定,并對(duì)國(guó)外一些國(guó)家對(duì)植物新品種的保護(hù)進(jìn)行了分析,其中以美國(guó)為主進(jìn)行了詳談。 第四部分主要介紹了我國(guó)對(duì)植物新品種保護(hù)的發(fā)展歷程,并對(duì)《植物新品種保護(hù)條例》進(jìn)行了仔細(xì)分析,總結(jié)出其優(yōu)缺點(diǎn)�？偨Y(jié)出我國(guó)目前在植物新品種保護(hù)方面存在的問(wèn)題。 第五部分通過(guò)與其他國(guó)家的比較,提出對(duì)我國(guó)植物新品種保護(hù)的完善方法。
[Abstract]:The right to plant new varieties is conferred on the breeders of new plant varieties by the administrative departments of the Ministry of Agriculture and Forestry and other administrative departments in accordance with the provisions of the laws and regulations within a certain period of time. An exclusive right to new varieties of plants. Variety rights as a new type of intellectual property, China has joined the WTO and must gradually fulfill the rules of international trade, including intellectual property rights. However, there is still a big gap between China and the trips agreement in the protection of intellectual property rights. As a new type of intellectual property, new plant varieties are even weaker. As a large agricultural country, Strengthening the intellectual property protection of new plant varieties plays an important role in the development of agriculture in China. This paper studies the current situation of protection of new plant varieties abroad and the general situation of protection of new varieties of plants in China. To explore the existing problems of intellectual property protection of new plant varieties in China and improve the methods. This paper is divided into five parts. In the first part, the background, present situation and value of new plant varieties are discussed. The second part mainly introduces the concept of new plant varieties, which is divided into "single type" protection mode and "compound type" protection mode according to the current international protection mode of new plant varieties. The third part mainly introduces the establishment of UPOV Convention and related regulations, and analyzes the protection of new plant varieties in some foreign countries, including the United States. Part 4th mainly introduces the development course of the protection of new plant varieties in China, and makes a careful analysis of the regulations on the Protection of New varieties of plants. Its advantages and disadvantages are summarized, and the problems existing in the protection of new plant varieties in China are summarized. In 5th, through comparison with other countries, the author puts forward the perfect methods for the protection of new plant varieties in China.
