【摘要】：縱觀全球經(jīng)濟(jì)的發(fā)展,知識(shí)經(jīng)濟(jì)不斷加快,知識(shí)產(chǎn)權(quán)的作用不斷顯現(xiàn),其成為了各國農(nóng)業(yè)發(fā)展的核心競(jìng)爭(zhēng)力。農(nóng)業(yè)知識(shí)產(chǎn)權(quán)的保護(hù)對(duì)農(nóng)業(yè)科研成果的和農(nóng)業(yè)科研工作者的積極性起到了重要作用。怎么讓農(nóng)業(yè)科學(xué)技術(shù)得到有效利用,更好地保護(hù)好農(nóng)業(yè)技術(shù)生產(chǎn)者的權(quán)利,使其積極性及創(chuàng)造性得到提升,這就需要我們利用知識(shí)產(chǎn)權(quán)來實(shí)現(xiàn)保護(hù)農(nóng)業(yè)科技成果面,并實(shí)現(xiàn)農(nóng)業(yè)科技資源合理配置,才能對(duì)農(nóng)業(yè)科技的發(fā)展起到積極的作用。 水稻是中國第一大糧食作物,作為我國農(nóng)業(yè)基礎(chǔ)中的基礎(chǔ),對(duì)其相關(guān)的知識(shí)產(chǎn)權(quán)保護(hù)的研究對(duì)促進(jìn)我國種業(yè)和核心競(jìng)爭(zhēng)力有現(xiàn)實(shí)意義。為客觀反映我國及我省水稻知識(shí)產(chǎn)權(quán)研發(fā)、申請(qǐng)、授權(quán)和轉(zhuǎn)化態(tài)勢(shì),本文以水稻新品種權(quán)、水稻育種領(lǐng)域?qū)＠夹g(shù)為主要研究對(duì)象,分析了截至2012年底我國及我省水稻知識(shí)產(chǎn)權(quán)保護(hù)與管理現(xiàn)狀,擬借此分析反映我國及我省水稻知識(shí)產(chǎn)權(quán)(水稻品種權(quán)、專利等)創(chuàng)造的數(shù)量趨勢(shì)、質(zhì)量狀況、技術(shù)領(lǐng)域分布、申請(qǐng)人構(gòu)成等特征。并指出在水稻知識(shí)產(chǎn)權(quán)保護(hù)工作中面臨的問題與挑戰(zhàn),并提出相應(yīng)的對(duì)策與建議。
[Abstract]:Throughout the development of the global economy, the knowledge economy has been speeding up, and the role of intellectual property has been emerging. It has become the core competitiveness of agricultural development in various countries. The protection of agricultural intellectual property plays an important role in agricultural research achievements and the enthusiasm of agricultural scientific research workers. How to make effective use of agricultural science and technology, To better protect the rights of agricultural technology producers and enhance their enthusiasm and creativity, we need to use intellectual property rights to realize the protection of agricultural scientific and technological achievements and the rational allocation of agricultural science and technology resources. Ability to play a positive role in the development of agricultural science and technology. Rice is the largest food crop in China and serves as the foundation of our agriculture. The research on the intellectual property protection is of practical significance to promote the seed industry and core competitiveness of our country. In order to objectively reflect the research and development, application, authorization and transformation of rice intellectual property rights in our country and in our province, this paper uses the rice new variety rights. As the main research object in the field of rice breeding, this paper analyzes the present situation of the protection and management of rice intellectual property rights in China and our province up to end of 2012, and intends to reflect the rice intellectual property rights (rice variety rights) in China and our province. It also points out the problems and challenges faced in the protection of rice intellectual property rights, and puts forward the corresponding countermeasures and suggestions.
