【摘要】：我國沉香產(chǎn)業(yè)目前正處在關鍵發(fā)展期，從傳統(tǒng)的制藥產(chǎn)業(yè)轉變?yōu)榧r(nóng)業(yè)、工業(yè)、文化業(yè)為一體的復合型產(chǎn)業(yè)，產(chǎn)業(yè)處于快速發(fā)展階段，未來產(chǎn)值可達千億元人民幣。沉香產(chǎn)業(yè)的關鍵環(huán)節(jié)和知識產(chǎn)權緊密聯(lián)系，知識產(chǎn)權保護在沉香產(chǎn)業(yè)發(fā)展中起著戰(zhàn)略性支撐作用。 文章首先分析了沉香的價值，正是由于沉香在藥用、文化、經(jīng)濟和生態(tài)方面的巨大價值的挖掘，沉香產(chǎn)業(yè)由傳統(tǒng)的沉香產(chǎn)業(yè)向集農(nóng)業(yè)、工業(yè)和文化業(yè)一體的復合型產(chǎn)業(yè)轉型升級，知識產(chǎn)權保護可以提升沉香產(chǎn)業(yè)核心競爭力，促進沉香產(chǎn)業(yè)升級。 通過對遺傳資源保護、專利保護、商標保護和版權保護等現(xiàn)有的方式分析，歸納出沉香產(chǎn)業(yè)目前在知識產(chǎn)權保護方式的不足，，即遺傳資源保護不力、企業(yè)不注重知識產(chǎn)權管理、商標保護意識弱等。 在此基礎上提出完善我國沉香產(chǎn)業(yè)的知識產(chǎn)權保護的宏觀思考，即在堅持生態(tài)價值與經(jīng)濟價值相平衡原則、技術創(chuàng)新與文化創(chuàng)新相結合原則和知識產(chǎn)權保護和公眾利益相平衡原則的前提下，將知識產(chǎn)權創(chuàng)造、運用保護和管理相結合，政府、行業(yè)和企業(yè)三方協(xié)作，建立完整的知識產(chǎn)權保護機制。并提出了具體的對策建議：在遺傳資源保護上，從現(xiàn)有的知識產(chǎn)權保護方式中用地理標志保護對沉香遺傳資源進行保護；在專利保護領域，要建立專利預警機制和運用重大科技經(jīng)濟知識產(chǎn)權審議機制；在商標保護領域，增強商標保護意識的同時要注重品牌的建設；同時其他保護方式協(xié)調運作。各種保護方式綜合運用，為沉香產(chǎn)業(yè)發(fā)展提供系統(tǒng)的知識產(chǎn)權保護。
[Abstract]:At present, the industry in China is in a critical stage of development. From the traditional pharmaceutical industry to a complex industry that integrates agriculture, industry and cultural industry, the industry is in a stage of rapid development. The future output value can reach 100 billion RMB. The key link of the industry is closely related to intellectual property rights, and intellectual property protection plays a strategic supporting role in the development of the industry. The paper first analyzes the value of the incense. It is precisely because of the great value of the medicinal, cultural, economic and ecological aspects that the industry has changed from the traditional industry to the agglomeration of agriculture. The industrial and cultural industries are one of the complex industries. Intellectual property protection can enhance the core competitiveness of the industry and promote the upgrading of the industry. Through the analysis of the existing ways of protecting genetic resources, patent protection, trademark protection and copyright protection, it is concluded that the current deficiency of the industry in protecting intellectual property rights, that is, the weak protection of genetic resources, Enterprises do not pay attention to intellectual property management, trademark protection awareness is weak. On this basis, the author puts forward the macroscopic thinking of perfecting the intellectual property protection of China's incense industry, that is, insisting on the principle of balance between ecological value and economic value. On the premise of combining technological innovation with cultural innovation and balancing intellectual property protection with public interest, we should combine intellectual property creation, application protection and management, and cooperate with government, industry and enterprises. To establish a complete intellectual property protection mechanism, and put forward specific countermeasures and suggestions: in the protection of genetic resources, the protection of genetic resources by geographical indications from the existing ways of intellectual property protection, in the field of patent protection, In the field of trademark protection, it is necessary to strengthen the consciousness of trademark protection and pay attention to the construction of the brand while establishing the mechanism of patent warning and the application of important intellectual property rights of science, technology and economy. At the same time, other protection methods operate harmoniously. All kinds of protection methods are used synthetically to provide systematic intellectual property protection for the development of incense industry.
