【摘要】：云計(jì)算的出現(xiàn)，使得信息技術(shù)領(lǐng)域發(fā)生重大變革，為我們提供了全新的商業(yè)模式和生活方式，，與此同時(shí)，我國知識(shí)產(chǎn)權(quán)保護(hù)制度也面臨著巨大的挑戰(zhàn)，傳統(tǒng)的版權(quán)保護(hù)也面臨前所未有的沖擊。計(jì)算機(jī)軟件作為信息技術(shù)的核心產(chǎn)業(yè)，在我國是屬于著作權(quán)的客體，其保護(hù)制度也必將接受云計(jì)算的考驗(yàn)。本文從科學(xué)技術(shù)與知識(shí)產(chǎn)權(quán)制度的關(guān)系出發(fā)，引出云計(jì)算對(duì)整個(gè)著作權(quán)體系的影響，然后將視角轉(zhuǎn)移到計(jì)算機(jī)軟件上，具體分析云計(jì)算背景下我國計(jì)算機(jī)軟件保護(hù)制度存在的弊端，最后根據(jù)我國實(shí)際情況，探索計(jì)算機(jī)軟件保護(hù)制度的未來之路。 本文第一章介紹云計(jì)算的起源、概念、特征，以及未來的發(fā)展展望，讓讀者了解云計(jì)算。 第二章分析云計(jì)算對(duì)整個(gè)著作權(quán)體系的影響。 第三章首先介紹我國現(xiàn)行的計(jì)算機(jī)軟件保護(hù)制度，再具體分析云計(jì)算對(duì)計(jì)算機(jī)軟件保護(hù)制度的具體影響。 第四章從著作權(quán)和專利權(quán)的角度分別分析云計(jì)算環(huán)境下計(jì)算機(jī)軟件保護(hù)制度的改進(jìn)。
[Abstract]:The emergence of cloud computing has made great changes in the field of information technology, providing us with a new business model and lifestyle. At the same time, our intellectual property protection system is also facing a huge challenge. As the core industry of information technology, computer software is the object of copyright in our country. From the relationship between science and technology and intellectual property system, this paper introduces the impact of cloud computing on the whole copyright system, and then transfers the perspective to computer software. This paper analyzes the drawbacks of computer software protection system in cloud computing background, and finally explores the future of computer software protection system according to the actual situation of our country. The first chapter of this paper introduces the origin, concept, characteristics and future development of cloud computing, so that readers can understand cloud computing. Chapter two analyzes the impact of cloud computing on the whole copyright system. The third chapter first introduces the current computer software protection system in China, and then analyzes the specific impact of cloud computing on computer software protection system. Chapter 4th analyzes the improvement of computer software protection system in cloud computing environment from the angle of copyright and patent.
