【摘要】:工業(yè)經(jīng)濟(jì)與信息經(jīng)濟(jì)相交錯(cuò)的復(fù)雜環(huán)境下,無(wú)論是發(fā)達(dá)國(guó)家還是發(fā)展中國(guó)家,都在競(jìng)相發(fā)展文化創(chuàng)意產(chǎn)業(yè),爭(zhēng)奪這塊無(wú)污染、高附加值的誘人蛋糕,以提升在世界范圍內(nèi)的競(jìng)爭(zhēng)力話語(yǔ)權(quán)。著作權(quán)是作者在文學(xué)藝術(shù)領(lǐng)域創(chuàng)作出的智力成果,是文化創(chuàng)意產(chǎn)業(yè)的核心資產(chǎn)。我們對(duì)文化創(chuàng)意產(chǎn)業(yè)的著作權(quán)保護(hù)相關(guān)問(wèn)題進(jìn)行研究具有十分必要的意義,不僅是國(guó)家文化戰(zhàn)略的需要,也是創(chuàng)意企業(yè)提高核心競(jìng)爭(zhēng)力的關(guān)鍵,更是對(duì)創(chuàng)作個(gè)體創(chuàng)新活動(dòng)的有效激勵(lì)。本文選擇以“藝術(shù)授權(quán)"為切入點(diǎn)研究文化創(chuàng)意產(chǎn)業(yè)的著作權(quán)保護(hù)問(wèn)題。因?yàn)椤八囆g(shù)授權(quán)”的實(shí)質(zhì)內(nèi)容是藝術(shù)作品著作權(quán)許可法律關(guān)系,藝術(shù)授權(quán)是藝術(shù)作品著作權(quán)在多層次、多方面得以有效利用的重要形式。同時(shí)我們比較了國(guó)內(nèi)外文化創(chuàng)意產(chǎn)業(yè)中藝術(shù)授權(quán)的實(shí)踐,以期總結(jié)出對(duì)我國(guó)當(dāng)前發(fā)展文化創(chuàng)意產(chǎn)業(yè)中藝術(shù)授權(quán)的著作權(quán)保護(hù)問(wèn)題有益的建議。 本文共分為三大部分,第一部分主要分析文化創(chuàng)意產(chǎn)業(yè)著作權(quán)保護(hù)的背景,從“文化”、“創(chuàng)意”、“產(chǎn)業(yè)”三個(gè)角度闡釋了文化創(chuàng)意產(chǎn)業(yè)的涵義;介紹了著作權(quán)保護(hù)對(duì)于文化創(chuàng)意產(chǎn)業(yè)發(fā)展的必要性;提出以藝術(shù)授權(quán)為切入點(diǎn)來(lái)研究文化創(chuàng)意產(chǎn)業(yè)著作權(quán)保護(hù)。 第二部分以英國(guó)、美國(guó)、日本、韓國(guó)為代表介紹了國(guó)外文化創(chuàng)意產(chǎn)業(yè)中藝術(shù)授權(quán)的實(shí)踐情況,接著對(duì)比介紹了我國(guó)國(guó)內(nèi)相關(guān)的發(fā)展實(shí)踐,總結(jié)出四點(diǎn)結(jié)論,認(rèn)為發(fā)達(dá)國(guó)家以其經(jīng)濟(jì)發(fā)展優(yōu)勢(shì)仍掌握著世界文化創(chuàng)意產(chǎn)業(yè)領(lǐng)域的話語(yǔ)權(quán),在藝術(shù)授權(quán)關(guān)系中往往處于授權(quán)方的主動(dòng)地位,我國(guó)應(yīng)結(jié)合自身經(jīng)濟(jì)發(fā)展的階段性特點(diǎn),在發(fā)展文化創(chuàng)意產(chǎn)業(yè)過(guò)程中對(duì)著作權(quán)的保護(hù)方面,制定符合我國(guó)利益的適度保護(hù)政策。 第三部分提出我國(guó)文化創(chuàng)意產(chǎn)業(yè)藝術(shù)授權(quán)著作權(quán)保護(hù)的建議。一是著作權(quán)人重視藝術(shù)授權(quán)合同訂立與履行中的著作權(quán)保護(hù);二是文化創(chuàng)意企業(yè)重視對(duì)藝術(shù)作品著作權(quán)許可工作的管理;三是著作權(quán)行業(yè)組織發(fā)揮保護(hù)力量。 本文的創(chuàng)新之處主要是: 1、以藝術(shù)授權(quán)為切入點(diǎn)來(lái)研究文化創(chuàng)意產(chǎn)業(yè)著作權(quán)保護(hù)問(wèn)題。 2、對(duì)“藝術(shù)授權(quán)"的概念做了開(kāi)拓性的解釋,提出藝術(shù)授權(quán)的實(shí)質(zhì)內(nèi)容在于著作權(quán)許可法律關(guān)系。 3、首次提出當(dāng)前我國(guó)文化創(chuàng)意產(chǎn)業(yè)著作權(quán)保護(hù)應(yīng)予立足的兩個(gè)方面:第一,原創(chuàng)權(quán)利人應(yīng)重視藝術(shù)授權(quán)合同的訂立與履行;第二,創(chuàng)意企業(yè)應(yīng)加加強(qiáng)著作權(quán)管理。 本文的不足之處: 受可獲得的外文資料的限制,對(duì)國(guó)外文化創(chuàng)意產(chǎn)業(yè)與授權(quán)產(chǎn)業(yè)的界定分析有限;同時(shí)受著作權(quán)等知識(shí)產(chǎn)權(quán)理論水平限制,在著作權(quán)保護(hù)建議上不夠深入。
[Abstract]:In the complex environment where the industrial economy and the information economy are intertwined, both developed and developing countries are competing to develop cultural and creative industries and compete for this attractive cake with no pollution and high added value. Copyright is the intellectual achievement of the author in the field of literature and art. It is the core asset of the cultural and creative industries. It is necessary for us to study the copyright protection of the cultural and creative industries, which is not only the need of the national cultural strategy, but also the key to enhance the core competitiveness of the creative enterprises. This paper chooses "art authorization" as the starting point to study the copyright protection of cultural and creative industries, because the essence of "artistic authorization" is the legal relationship of copyright licensing of art works. Art authorisation is an important form of art copyright that can be effectively used in multiple levels and aspects. At the same time, we have compared the practice of artistic authorization in cultural and creative industries at home and abroad. In order to sum up the current development of cultural and creative industries in China, the copyright protection of artistic authorization is beneficial. This paper is divided into three parts. The first part mainly analyzes the background of copyright protection of cultural and creative industries, and explains the meaning of cultural creative industry from the three angles of "culture", "creativity" and "industry". This paper introduces the necessity of copyright protection for the development of cultural and creative industries, and puts forward that the copyright protection of cultural and creative industries should be studied from the point of view of artistic authorization. The second part takes the United Kingdom, the United States, Japan and South Korea as the representatives to introduce the practice of artistic licensing in foreign cultural and creative industries, and then compares the relevant development practices in China and concludes four conclusions. It is believed that the developed countries still hold the right to speak in the field of cultural and creative industries in the world by virtue of their advantages of economic development and are often in the active position of the authorized parties in the relationship of artistic licensing, and that China should combine the stage characteristics of its own economic development. In the process of developing cultural and creative industries, we should make appropriate protection policies in line with the interests of our country. The third part puts forward some suggestions on the copyright protection of cultural and creative industries. Firstly, the copyright owners attach importance to the copyright protection in the process of concluding and performing the artistic authorization contracts. Second, cultural and creative enterprises attach importance to the management of copyright licensing of works of art, and third, copyright industry organizations play a protective role. The innovations of this paper are as follows:. 1. To study the copyright protection of cultural and creative industries from the point of view of artistic authorization. 2. The concept of "art license" is interpreted in a pioneering way, and the essence of art authorization lies in the legal relationship of copyright license. Thirdly, the author points out for the first time that the copyright protection of the cultural and creative industries in our country should be based on two aspects: first, the original right holders should pay attention to the conclusion and implementation of the contract of artistic authorization; second, the creative enterprises should strengthen the copyright management. The shortcomings of this paper:. Limited by the available foreign language materials, the definition and analysis of foreign cultural and creative industries and authorized industries are limited, and the theoretical level of intellectual property rights such as copyright is limited, so the suggestions for copyright protection are not deep enough.
