【摘要】：作為知識經(jīng)濟最重要的特征,知識產權已成為許多國家和地區(qū)在經(jīng)濟、技術、文化等領域進行激烈競爭的戰(zhàn)略手段和核心競爭力,也是確保國民經(jīng)濟長期健康發(fā)展的焦點和關鍵因素。知識產權既是一種財產權,更是一種生產要素,是推動和保障經(jīng)濟發(fā)展的基本制度。其激勵作用促進了技術創(chuàng)新,法律保障作用保證了經(jīng)濟財富的實現(xiàn)。而中小微型企業(yè)是我國創(chuàng)造社會財富的主體之一,是解決百姓就業(yè)問題的主力軍,是推動我國國民經(jīng)濟平穩(wěn)加快發(fā)展,促進社會和諧不可或缺的重要力量,更是技術創(chuàng)新方面的生力軍。近年來,知識產權也日益受到廣東惠州政府和企業(yè)的高度重視,惠州政府在大力支持科研項目和成果產出的同時,制定了以自主創(chuàng)新為主體的知識產權保護戰(zhàn)略。知識產權保護與地區(qū)經(jīng)濟發(fā)展有著非常緊密的關系,惠州市的經(jīng)濟發(fā)展程度決定了其知識產權保護的力度�；葜菔凶鳛檐Q身“珠三角第二梯隊”的生力軍,將科技創(chuàng)新作為經(jīng)濟發(fā)展的主動力,加大力度打擊和遏制知識產權侵權、犯罪行為,正確引導和保護全市中小微型企業(yè)合法利用知識產權,將知識產權保護作為中小微型企業(yè)經(jīng)濟可持續(xù)發(fā)展的重要保障,是當前惠州市的一項重要的戰(zhàn)略任務。研究惠州市中小微型企業(yè)知識產權保護現(xiàn)狀、存在的問題,并提出相應的對策和建議,對全市未來的經(jīng)濟發(fā)展有著重要的現(xiàn)實意義。本文立足于已有的研究成果,從國內外知識產權保護相關理論出發(fā),收集大量的資料、數(shù)據(jù)等素材,結合惠州市經(jīng)濟發(fā)展和產業(yè)結構等特點,著重從專利權的保護方面入手,從不同角度研究惠州市中小微型企業(yè)知識產權的保護現(xiàn)狀和問題,并從少數(shù)企業(yè)知識產權糾紛的典型案例著手,找出其中的特征和規(guī)律,深刻剖析目前阻礙惠州市知識產權更快、更好發(fā)展的客觀原因,提出相應的對策和建議,從而促進惠州市知識產權保護的更加完善,推動全市知識產權經(jīng)濟的長足發(fā)展。
[Abstract]:As the most important feature of knowledge economy, intellectual property has become a strategic means and core competitiveness for many countries and regions to compete intensely in the fields of economy, technology, culture, etc. Intellectual property is not only a property right, but also a factor of production, and a basic system to promote and guarantee economic development. The role of legal protection guarantees the realization of economic wealth. And small and medium-sized microenterprises are one of the main bodies of social wealth creation in our country, the main force in solving the problem of employment among the people, and the promotion of the steady and accelerated development of our national economy. In recent years, intellectual property rights have increasingly been attached great importance to by the Guangdong Huizhou government and enterprises. While vigorously supporting scientific research projects and achievements, the Huizhou government has formulated an intellectual property protection strategy with independent innovation as the main body. The protection of intellectual property rights has a very close relationship with regional economic development. The degree of economic development in Huizhou City determines the strength of its intellectual property protection. As a new force among the "second echelon of the Pearl River Delta," Huizhou takes scientific and technological innovation as the main driving force for economic development, and increases its efforts to crack down and curb intellectual property infringement. Criminal acts, correctly guide and protect the legitimate use of intellectual property rights by small and medium-sized microenterprises in the city, and regard the protection of intellectual property rights as an important guarantee for the sustainable economic development of small and medium-sized microenterprises, It is an important strategic task of Huizhou at present. This paper studies the current situation and problems of intellectual property protection of small and medium-sized enterprises in Huizhou, and puts forward corresponding countermeasures and suggestions. It is of great practical significance to the future economic development of the whole city. Based on the existing research results, this paper starts from the relevant theories of intellectual property protection at home and abroad, collects a large amount of materials, such as data, and so on. According to the characteristics of economic development and industrial structure of Huizhou City, the current situation and problems of intellectual property protection of small and medium-sized enterprises in Huizhou are studied from different angles, starting with the protection of patent rights. Starting from the typical cases of intellectual property disputes in a few enterprises, this paper finds out the characteristics and laws, deeply analyzes the objective reasons that hinder the faster and better development of intellectual property rights in Huizhou City, and puts forward corresponding countermeasures and suggestions. In order to promote the protection of intellectual property rights in Huizhou more perfect, promote the considerable development of intellectual property economy.
