實(shí)用藝術(shù)作品的知識產(chǎn)權(quán)保護(hù)問題研究

【摘要】: 實(shí)用藝術(shù)作品兼具藝術(shù)性和實(shí)用性兩重特性,處在知識產(chǎn)權(quán)各部門法保護(hù)領(lǐng)域重疊交融的部分,因此其保護(hù)成為知識產(chǎn)權(quán)領(lǐng)域的一大難題。 如何解決這一難題是本文的中心內(nèi)容,實(shí)用藝術(shù)作品的內(nèi)容龐雜、外延寬泛,既不能將其歸入某個(gè)傳統(tǒng)的保護(hù)主題之下(如美術(shù)作品),也不能獨(dú)立自成一個(gè)主題來保護(hù)。筆者認(rèn)為妥善的做法是先通過解構(gòu)分析將所有被稱為“實(shí)用藝術(shù)作品”的智力成果分解開來,再根據(jù)其各部分特征進(jìn)行契合歸入,恰當(dāng)?shù)刂糜谥R產(chǎn)權(quán)各部門法的保護(hù)領(lǐng)域中進(jìn)行保護(hù)。 本文第一章介紹實(shí)用藝術(shù)作品的概念并對其進(jìn)行解構(gòu),解構(gòu)出其實(shí)用性、藝術(shù)性及獨(dú)創(chuàng)性三大特征并在此基礎(chǔ)上做分類,為分部分認(rèn)定其法律性質(zhì)做準(zhǔn)備。 第二章是實(shí)用藝術(shù)作品保護(hù)的國際法規(guī)定和西方一些國家的立法概覽,并以美國為典型,圍繞保護(hù)模式和法律定性兩個(gè)問題對其相關(guān)立法與司法實(shí)踐做詳細(xì)介紹,同時(shí)指出其不足,為我國制度完善提供借鑒參考。 第三章介紹我國實(shí)用藝術(shù)作品保護(hù)的立法和司法實(shí)踐,并指出目前做法的弊端所在,為我國實(shí)用藝術(shù)作品知識產(chǎn)權(quán)保護(hù)制度的完善指出方向和目標(biāo)。與美國相對應(yīng),本章論述同樣圍繞上述兩個(gè)問題進(jìn)行。 第四章在前述三章的基礎(chǔ)上對我國的實(shí)用藝術(shù)作品知識產(chǎn)權(quán)保護(hù)制度提出筆者自己的設(shè)計(jì)和完善意見。 本文還有一條“暗線”伏于其中,第一章解構(gòu)出實(shí)用藝術(shù)作品的三大特征,闡述了解構(gòu)實(shí)用藝術(shù)作品的依據(jù)(即自身特征);第二章的美國微觀論述了分離原則,它和在它基礎(chǔ)上發(fā)展而來的“定量分離”法一同闡述了解構(gòu)實(shí)用藝術(shù)作品的方法(即如何解構(gòu)的問題);解構(gòu)之后,在化整為零的基礎(chǔ)上進(jìn)行契合歸入,完成我國實(shí)用藝術(shù)作品保護(hù)制度的設(shè)計(jì)。
[Abstract]:Practical works of art have the characteristics of both artistry and practicability, and they are in the overlapping and blending part of various branches of intellectual property protection, so their protection has become a major problem in the field of intellectual property. How to solve this problem is the central content of this paper, the content of practical works of art is complex and extensive, which can not be classified under a traditional protection theme (such as art works). The author thinks that it is good to decompose all the intellectual achievements which are called "practical works of art" through deconstruction analysis. According to the characteristics of each part of it, it is properly placed in the field of protection of intellectual property law. The first chapter introduces the concept of practical works of art and deconstructs them, and deconstructs its practical, artistic and original features and classifies them on this basis, in order to make preparations for determining the legal nature of the works in different parts. The second chapter is an overview of the protection of practical works of art in international law and some western countries, and the United States as a model. This paper introduces the relevant legislation and judicial practice around the protection mode and the legal characterization, and points out its shortcomings, which provides a reference for the perfection of our country's system. The third chapter introduces the legislative and judicial practice of the protection of practical works of art in China, and points out the drawbacks of the present practice. This chapter points out the direction and goal for the improvement of intellectual property protection system of practical works of art in China. On the basis of the above three chapters, Chapter 4th puts forward the author's own design and perfection suggestions on the intellectual property protection system of practical works of art in China. This article also has a "dark line" in which, the first chapter deconstructs the three characteristics of practical works of art, elaborated the basis of deconstruction of practical works of art (that is, their own characteristics); The second chapter discusses the principle of separation from the micro point of the United States, which, together with the "quantitative separation" method developed on the basis of it, expounds the method of deconstructing practical works of art (that is, the problem of how to deconstruct it). After deconstruction, on the basis of integration, complete the design of protection system of practical works of art in China.
