【摘要】：文章針對(duì)一些國(guó)家、企業(yè)或個(gè)人對(duì)已過(guò)版權(quán)保護(hù)期限的古籍文獻(xiàn)、早已記載于文獻(xiàn)或公開(kāi)的中醫(yī)藥配方搶先申請(qǐng)專(zhuān)利的行為,提出依據(jù)《生物多樣性公約》中的國(guó)家主權(quán)、知情同意、惠益分享三原則和中醫(yī)藥特點(diǎn),確立中醫(yī)藥作品、中醫(yī)配方版權(quán)保護(hù)和中醫(yī)藥申報(bào)專(zhuān)利的新穎性、創(chuàng)造性判定標(biāo)準(zhǔn),從而使中醫(yī)藥傳統(tǒng)知識(shí)產(chǎn)權(quán)獲得更好地保護(hù)。
[Abstract]:This article aims at some countries, the enterprise or the individual to have passed the copyright protection time limit ancient book document, has already recorded in the literature or the open Chinese medicine formula to apply for the patent behavior first. According to the three principles of national sovereignty, informed consent, benefit-sharing and the characteristics of Chinese medicine in the Convention on Biological Diversity, to establish the copyright protection of traditional Chinese medicine formulations and the novelty of Chinese medicine patent application. Creative judgment criteria, so that traditional Chinese medicine intellectual property rights to obtain better protection.
