【摘要】：隨著中國(guó)社會(huì)經(jīng)濟(jì)的快速進(jìn)步,我國(guó)人民的生活水平越來(lái)越高,科學(xué)技術(shù)的進(jìn)步速度加快,人們身邊科技的滲透越來(lái)越多,而移動(dòng)網(wǎng)絡(luò)的普及將人們的生活引入了一個(gè)新時(shí)代,電子設(shè)備尤其是移動(dòng)終端的研究使得各種形形色色的APP逐漸出現(xiàn)在人們的視野當(dāng)中,APP的應(yīng)用和交易呈現(xiàn)出繁榮和發(fā)展的景象,同樣,國(guó)內(nèi)和國(guó)外市場(chǎng)的繁榮背后都蘊(yùn)含著各種各樣的問(wèn)題,例如APP知識(shí)產(chǎn)權(quán)的保護(hù)和侵害APP用戶權(quán)益的問(wèn)題,選擇APP線上交易作為研究的主題就是在此基礎(chǔ)上誕生的。 本文共分五章,緒論部分主要介紹課題的研究背景、意義和國(guó)內(nèi)外研究現(xiàn)狀；第一章重點(diǎn)針對(duì)APP線上交易的現(xiàn)狀,概述了APP線上交易的現(xiàn)狀和發(fā)展趨勢(shì)；第二、三、四章分別就APP線上交易中賣方的倫理職責(zé)、買方的倫理職責(zé)以及第三方進(jìn)行了分析和論述,對(duì)APP賣方和買方的相關(guān)優(yōu)勢(shì)和由此構(gòu)建相應(yīng)倫理規(guī)則進(jìn)行了討論,并進(jìn)一步的針對(duì)第三方的界定和其倫理職責(zé)進(jìn)行了研究；最后一章針對(duì)APP線上交易過(guò)程中出現(xiàn)的問(wèn)題進(jìn)行了研究,并探索相應(yīng)的倫理對(duì)策。 文章通過(guò)對(duì)APP線上交易方的倫理職責(zé)進(jìn)行研究,幫助線上市場(chǎng)交易方在倫理職責(zé)領(lǐng)域進(jìn)一步完善,揭示在交易過(guò)程中確立倫理原則的重要性,同時(shí)闡述市場(chǎng)中依然存在的問(wèn)題,說(shuō)明保護(hù)知識(shí)產(chǎn)權(quán)和用戶合法權(quán)益不僅具有正當(dāng)性,還對(duì)整個(gè)線上市場(chǎng)的健康與繁榮具有重要的意義和積極的作用。
[Abstract]:With the rapid progress of China's social economy, the living standard of our people is getting higher and higher, the speed of science and technology progress is speeding up, and the infiltration of science and technology around people is more and more. The popularity of mobile networks will lead people's lives into a new era. The research of electronic devices, especially mobile terminals, makes various kinds of APP gradually appear in people's vision. The application and transaction of APP show prosperity and development. Similarly, there are all kinds of problems behind the prosperity of domestic and foreign markets. For example, the protection of APP intellectual property rights and the infringement of APP user rights and interests, the choice of APP online trading as the theme of research is based on the birth of this foundation. This paper is divided into five chapters, the introduction mainly introduces the research background, significance and research status at home and abroad; The first chapter focuses on the current situation of APP online trading, summarizes the current situation and development trend of APP online trading; The second, third and fourth chapters respectively analyze and discuss the ethical duties of the seller, the buyer and the third party in the online transaction of APP. This paper discusses the relative advantages of APP seller and buyer and constructs the corresponding ethical rules, and further studies the definition and ethical responsibility of third party. In the last chapter, the problems in APP online trading are studied, and the corresponding ethical countermeasures are explored. Through the study of the ethical responsibilities of online traders in APP, this paper helps online traders to further improve their ethical responsibilities, and reveals the importance of establishing ethical principles in the course of transactions. At the same time, the problems that still exist in the market are expounded, which shows that the protection of intellectual property rights and the legitimate rights and interests of users is not only legitimate, but also of great significance and positive effect to the health and prosperity of the whole online market.
