【摘要】：地理標識作為一類新的知識產(chǎn)權，其客體的本質(zhì)就是一種信息，向人們揭示了某種商品的質(zhì)量、信譽等特征與特定地理區(qū)域的自然人文環(huán)境之間所存在的密切聯(lián)系。正由于地理標識所具有的這種標示功能，對于地理標識產(chǎn)品的合法生產(chǎn)者而言，地理標識本身就是一種無形的資產(chǎn)，，能夠給自己帶來財富和良好的商譽，而對于廣大消費者和用戶而言，地理標識既意味著商品的經(jīng)營者做出了某種承諾和保證，又是商品本身具有區(qū)別于其他同類產(chǎn)品的獨特品質(zhì)的象征。因此，一方面，由于地理標識所蘊涵的極大商業(yè)價值，對它進行立法保護，體現(xiàn)了對智力成果的尊重，對創(chuàng)造性勞動的承認；另一方面，對使用地理標識的行為加以監(jiān)管，對地理標識侵權行為加以打擊，也是維護廣大消費者和用戶的合法權益的必然要求。 地理標識本身的價值、國際交往的進一步加強、經(jīng)濟的全球化、加入世界貿(mào)易組織等因素都要求我國這樣一個地理標識資源大國確立地理標識法律制度。通過對《商標法》及其附屬法規(guī)和規(guī)章的不斷修改，通過《原產(chǎn)地域產(chǎn)品保護規(guī)定》、《地理標識產(chǎn)品保護規(guī)定》等部門規(guī)章的制定，我國地理標識法律保護制度已經(jīng)初步建立起來。但是，由于我國對地理標識保護工作的重視沒有提高到應有的程度以及與地理標識問題有關的理論研究和保護實踐的相對滯后，我國地理標識制度還很不完善，還有許多地方需要進一步的健全和優(yōu)化。 基于地理標識保護的必要性和我國地理標識法制所存在的問題，在本文中，筆者以對地理標識的概念等基本理論問題的分析為起點，以完善我國地理標識法制為目的和歸宿，著重在地理標識的權利屬性、目前以TRIPS協(xié)議為視角地理標識國際保護的現(xiàn)狀和問題、我國現(xiàn)行的地理標識保護制度及其存在的不足、完善我國地理標識法制的具體構想等方面進行了思考和闡述。本文的寫作旨在通過進一步深化對地理標識法律問題的研究，為我國地理標識保護實踐工作的開展，為我國地理標識法律制度的完善，提供更加堅實的理論基礎。
[Abstract]:Geographical indication as a new kind of intellectual property, the essence of its object is a kind of information, which reveals the quality of a certain commodity to people. The close relationship between the characteristics such as reputation and the natural and human environment of a particular geographical region. It is precisely because of the geographical indication of this kind of marking function, for the legitimate producers of geographical indication products. Geographical indication itself is an intangible asset, can bring themselves wealth and good goodwill, and for the vast number of consumers and users. Geographical indication not only means that the operator of the commodity has made a certain commitment and guarantee, but also is a symbol of the commodity itself with a unique quality different from other similar products. Therefore, on the one hand. Because of the great commercial value of geographical indication, it is protected by legislation, which embodies the respect for intellectual achievements and the recognition of creative labor. On the other hand, it is necessary to supervise the use of geographical indications and crack down on the infringement of geographical indications, which is necessary to safeguard the legitimate rights and interests of consumers and users. The value of geographical indications, the further enhancement of international communication, and the globalization of economy. China's accession to the World Trade Organization and other factors require that such a large country of geographical indication resources establish a legal system of geographical indications, and through the continuous revision of the Trademark Law and its subsidiary laws and regulations. Through the establishment of the regulations on the protection of products of origin and geographical indications, the legal protection system of geographical indications in China has been preliminarily established. Due to the fact that our country does not pay more attention to the protection of geographical indications and the relative lag of the theoretical research and protection practice related to the problem of geographical indications, the system of geographical indications in our country is not perfect. There are many more areas that need further improvement and optimization. Based on the necessity of the protection of geographical indications and the problems existing in the legal system of geographical indications in China, the author starts with the analysis of the basic theoretical issues such as the concept of geographical indications in this paper. In order to perfect the legal system of geographical indication in our country as the purpose and destination, focusing on the right attributes of geographical indications, the current situation and problems of international protection of geographical indications from the perspective of TRIPS protocol. China's current geographical indication protection system and its shortcomings. The purpose of this paper is to further deepen the research on the legal issues of geographical indications through the further deepening of the study of the legal issues of geographical indications. It provides a more solid theoretical basis for the development of the practice of geographical indication protection in China and the perfection of the legal system of geographical indication in our country.
