【摘要】：作為一種新興的知識產(chǎn)權(quán),體育賽事網(wǎng)絡(luò)轉(zhuǎn)播權(quán)具有主體復(fù)雜、客體多樣、侵權(quán)行為具有社會危害性和侵權(quán)證據(jù)不易保全的特征。我國相關(guān)立法欠缺、執(zhí)法不嚴(yán)以及綜合管理體制有缺陷,這使得我國體育賽事網(wǎng)絡(luò)轉(zhuǎn)播權(quán)益得不到有效保護(hù)。應(yīng)當(dāng)通過完善立法、加強(qiáng)綜合執(zhí)法管理以及強(qiáng)化行業(yè)自律,構(gòu)建體育賽事網(wǎng)絡(luò)傳播法律保護(hù)體系,切實推動我國體育產(chǎn)業(yè)良性發(fā)展。
[Abstract]:As a new intellectual property right, the network broadcasting right of sports events has the characteristics of complex subject, diverse object, social harmfulness and hard to preserve the evidence of infringement, and the lack of relevant legislation in our country. The lax enforcement of the law and the defects of the comprehensive management system, which makes the rights and interests of the network broadcast of sports events in our country can not be effectively protected. We should improve legislation, strengthen comprehensive law enforcement management and strengthen the self-discipline of the industry. To construct the legal protection system of network communication of sports events and promote the healthy development of sports industry in China.
