【摘要】：農(nóng)村土地制度的改革的核心是土地的三權(quán)分置問題。土地的三權(quán)分置是一個實踐中已經(jīng)長期客觀存在的法律事實,法律必須對此予以回應(yīng)。集體所有權(quán)、承包權(quán)和經(jīng)營權(quán),如果從傳統(tǒng)物權(quán)理論出發(fā),則勢必違反物權(quán)法定和一物一權(quán)的原則。現(xiàn)行學(xué)術(shù)界的討論一定程度上混淆了政策概念和法律概念,混淆了權(quán)能概念和權(quán)利概念,糾結(jié)于是否增加新的用益物權(quán)類型"土地經(jīng)營權(quán)",沒有抓到"牛鼻子"。文本從事實(中國農(nóng)村土地流轉(zhuǎn)實踐,功能主義)出發(fā),從中央文件和現(xiàn)行法律體系(對實踐大量調(diào)研基礎(chǔ)上的中央政策和現(xiàn)行法律體系)出發(fā),從經(jīng)濟、法律、歷史、社會的綜合視角出發(fā),對于三權(quán)(事實上的四權(quán):土地所有權(quán)、土地承包權(quán)、土地承包經(jīng)營權(quán)、土地經(jīng)營權(quán))進行梳理,學(xué)術(shù)界目前主張的土地所有權(quán)→土地承包經(jīng)營權(quán)→土地承包權(quán)+土地經(jīng)營權(quán)的法理邏輯是不恰當(dāng)?shù)�。而農(nóng)村土地三權(quán)分置的內(nèi)在邏輯應(yīng)該是土地所有權(quán)→土地承包權(quán)→土地承包經(jīng)營權(quán)(土地經(jīng)營權(quán)僅為其權(quán)能)。并在此基礎(chǔ)上提出農(nóng)村土地三權(quán)分置的路徑之選擇。
[Abstract]:The core of the reform of the rural land system is the three-power split of the land. The three-right division of land is a legal fact that has long existed in practice, and the law must respond to it. The right of collective ownership, the right of contracting and the management of the right of operation, if from the traditional theory of real right, will violate the principle of the law of real right and the principle of one's one's right. The discussion of the current academic circles has confused the concept of the policy and the legal concept to some extent, confounded the concept of the power and the concept of the right, and the new "land management right" of usufructuary right is not caught, and the "a cow's nose" has not been caught. Starting from the facts (the practice and functionalism of the rural land circulation in China), the paper starts from the comprehensive view of economy, law, history and society from the perspective of the central documents and the existing legal system (the central policy and the existing legal system on the basis of large-scale research on practice). It is not appropriate to comb the right of land ownership, the right of land contracting, the right of land contracting and the legal logic of the right of land management for three rights (in fact, four rights: land ownership, land contract right, land contract management right and land management right). However, the internal logic of the non-tradable shares of the rural land should be the land ownership, the land contract right and the land contract management right (the land management right is only the power of the land). On the basis of this, the author puts forward the choice of the path of the three-power split in the rural land.
