海上搜救的“諾斯悖論”及其破解——基于公共選擇理論的分析

【摘要】:海上搜救既是履行公共服務職能的具體體現,也是履行國際公約義務的表現。目前我國海上搜救正從一元管理向多元治理轉變。隨著參與主體的日益多元化,受到其"經濟人"屬性和制度缺失的疊加影響,海上搜救呈現出"諾斯悖論":多元參與主體的存在是提高海上搜救能力的關鍵,又是影響海上搜救成效的根源。破解"諾斯悖論"之道在于:強化激勵機制,激發(fā)各主體的參與熱情;完善監(jiān)督機制,防范侵害公共利益的行為;培育志愿精神,營造良好的社會氛圍。
[Abstract]:Maritime search and rescue is not only the embodiment of public service functions, but also the performance of international convention obligations. At present, China's maritime search and rescue is changing from unitary management to multi-governance. With the increasing diversification of participants and the superposition of their "economic man" attributes and institutional deficiencies, maritime search and rescue presents the "North Paradox": the existence of multiple participants is the key to improve the ability of maritime search and rescue. It is also the root of the impact on the effectiveness of maritime search and rescue. The way to solve the "North Paradox" is to strengthen the incentive mechanism, stimulate the participation enthusiasm of each subject, perfect the supervision mechanism, prevent the behavior that infringes on the public interest, cultivate the volunteerism, and create a good social atmosphere.
