【摘要】：非政府組織作為政府和企業(yè)以外的第三部門，對于促進(jìn)政治民主、經(jīng)濟(jì)發(fā)展、文化繁榮、生態(tài)良好等各個(gè)方面起到很大的作用。從法律層面上來說，非政府組織是實(shí)現(xiàn)公民結(jié)社自由的一種方式，是公民結(jié)社自由從法律條款走向現(xiàn)實(shí)的有效途徑。 我國非政府組織法律形式是混亂的。非政府組織的法律形式是社會團(tuán)體法人。基金會、民辦非企業(yè)單位是社會團(tuán)體法人的下位概念。但基金會、民辦非企業(yè)單位與社會團(tuán)體并具備統(tǒng)一特征，將這些全部歸于社會團(tuán)體法人的做法存在邏輯矛盾。此外，，民辦非企業(yè)單位與事業(yè)單位并無本質(zhì)區(qū)別，僅因?yàn)橘Y金來源不同而將兩者割裂開來并不科學(xué)。形式的混亂導(dǎo)致配套法律對民辦非企業(yè)單位、事業(yè)單位的規(guī)定思路不清、問題叢生。這也是造成法律實(shí)施困難的主要原因。因此加強(qiáng)對非政府組織法律形式研究具有重要意義。 本文主要分五部分對非政府組織法律形式進(jìn)行研究： 第一部分非政府組織概述。主要介紹了非政府組織及組織法律形式的涵義、非政府組織與相似概念的區(qū)別及非政府組織存在的法理基礎(chǔ)。第二部分國外非政府組織法律形式考察。在介紹了日本和美國非政府組織法律形式的基礎(chǔ)上，分析對比了日本財(cái)團(tuán)法人制度和美國公益信托制度的不同。第三部分闡述了我國非政府組織法律形式，包括社會團(tuán)體法人、基金會、民辦非企業(yè)單位和其他類型的非政府組織。第四部分非政府組織法律形式缺陷。指出我國非政府組織法律形式存在的問題，社會團(tuán)體法人存在缺陷；民辦非企業(yè)單位存在邏輯矛盾；公益信托制度不符合我國國情。最后一部分是主張引入財(cái)團(tuán)法人完善我國非政府組織的法律形式。通過前幾章的論述得出引進(jìn)財(cái)團(tuán)法人是完善我國非政府組織法律形式的必然選擇，并分析引入的可行性和必要性及引入后我國非政府組織法律形式的新體系。
[Abstract]:The non-governmental organization, as the third department outside the government and the enterprise, plays a great role in promoting political democracy, economic development, cultural prosperity and good ecology.
