【摘要】：十八大報告指出,建設(shè)生態(tài)文明,是關(guān)系人民福祉、關(guān)乎民族未來的長遠(yuǎn)大計(jì)。面對資源約束趨緊、環(huán)境污染嚴(yán)重、生態(tài)系統(tǒng)退化的嚴(yán)峻形勢,必須樹立尊重自然、順應(yīng)自然、保護(hù)自然的生態(tài)文明理念,把生態(tài)文明建設(shè)放在突出地位,融入經(jīng)濟(jì)建設(shè)、政治建設(shè)、文化建設(shè)、社會建設(shè)各方面和全過程,努力建設(shè)美麗中國,實(shí)現(xiàn)中華民族永續(xù)發(fā)展。十八屆三中全會通過的《中共中央關(guān)于全面深化改革若干重大問題的決定》也強(qiáng)調(diào)我們要緊緊圍繞建設(shè)美麗中國深化生態(tài)文明體制改革,加快建立生態(tài)文明制度,健全國土空間開發(fā)、資源節(jié)約利用、生態(tài)環(huán)境保護(hù)的體制機(jī)制,推動形成人與自然和諧發(fā)展現(xiàn)代化建設(shè)新格局。因而我們有必要加強(qiáng)環(huán)境保護(hù)工作的建設(shè)。本文通過近日對沈陽市特別是沈北新區(qū)和鐵西區(qū)的環(huán)境管理行政執(zhí)法方面進(jìn)行調(diào)研,以沈陽市環(huán)境保護(hù)與資源保護(hù)的管理與執(zhí)法方面的問題為例,結(jié)合目前我國在環(huán)境保護(hù)方面取得的成效和存在的問題進(jìn)行分析,找出其存在問題的原因,從而找到解決該問題的對策,對癥下藥,以更好的為環(huán)境管理與行政執(zhí)法探索出一條創(chuàng)新發(fā)展之路。本文首先對核心概念的界定展開論述,明確了環(huán)境管理和環(huán)境行政執(zhí)法的概念界限,加上作者對該核心概念的獨(dú)特見解,使得對我國環(huán)境管理行政執(zhí)法研究的理論性更強(qiáng)。接著從我國環(huán)境管理行政執(zhí)法依據(jù)的相關(guān)法律法規(guī)和目前所取得的現(xiàn)實(shí)成效兩個方面論述我國環(huán)境管理行政執(zhí)法的現(xiàn)狀,有助于加深對我國環(huán)境管理行政執(zhí)法的了解,利于尋找我國環(huán)境管理行政執(zhí)法的問題并對問題進(jìn)行有效分析。然后,分別從我國環(huán)境管理行政執(zhí)法的立法、實(shí)施和監(jiān)督等角度剖析我國環(huán)境管理行政執(zhí)法所存在的問題。并且分別從我國環(huán)境管理行政執(zhí)法機(jī)制、環(huán)境管理行政執(zhí)法操作和監(jiān)督等角度分析原因。經(jīng)過有效的原因分析,放眼全球,文章分別闡述了美國和日本環(huán)境管理行政執(zhí)法的特點(diǎn)并分析了兩國的先進(jìn)經(jīng)驗(yàn)給我們帶來了哪些啟示。在文章的最后,筆者從我國環(huán)境保護(hù)立法,加強(qiáng)我國環(huán)境行政執(zhí)法執(zhí)行力度、完善我國環(huán)境管理行政執(zhí)法隊(duì)伍建設(shè)和監(jiān)督機(jī)制等方面提出解決我國環(huán)境管理行政執(zhí)法存在的問題,并總結(jié)了本文研究的不足之處。
[Abstract]:The report of the Eighteenth National Congress points out that the construction of ecological civilization is a long-term plan related to the well-being of the people and the future of the nation. In the face of the severe situation of tight resource constraints, serious environmental pollution and degradation of the ecosystem, we must establish the concept of ecological civilization that respects nature, complies with nature and protects nature, puts the construction of ecological civilization in a prominent position and integrates it into economic construction. Political construction, cultural construction, social construction, all aspects and the whole process, efforts to build a beautiful China, to achieve sustainable development of the Chinese nation. The "decision of the CPC Central Committee on comprehensively deepening several important issues of Reform" adopted at the third Plenary session of the 18th CPC Central Committee also stressed that we should deepen the reform of the ecological civilization system and speed up the establishment of the ecological civilization system closely around the construction of a beautiful China. It is necessary to perfect the system and mechanism of land and space development, resource conservation and utilization, and ecological and environmental protection to promote the formation of a new pattern of harmonious development of human beings and nature. Therefore, it is necessary for us to strengthen the construction of environmental protection work. Based on the recent investigation of the administrative law enforcement of environmental management in Shenyang, especially in Shenyang New District and Tiexi District, this paper takes the management and enforcement of environmental protection and resource protection in Shenyang as an example. With the analysis of the achievements and problems in environmental protection in China at present, we can find out the causes of the problems, and find out the countermeasures to solve the problems. In order to better environmental management and administrative law enforcement to explore a way of innovation and development. This paper first discusses the definition of the core concept, defines the concept of environmental management and environmental administrative law enforcement, combined with the author's unique views on the core concept, makes the study of environmental management administrative law enforcement in China more theoretical. Then, from the related laws and regulations of our country's environmental management administrative law enforcement basis and the actual results obtained at present, this paper discusses the present situation of our country's environmental management administrative law enforcement, which is helpful to deepen the understanding of our country's environmental management administrative law enforcement. It is propitious to find the problems of administrative law enforcement of environmental management in our country and analyze the problems effectively. Then, from the angle of legislation, implementation and supervision of administrative law enforcement of environmental management in China, this paper analyzes the existing problems of administrative law enforcement of environmental management in China. The reasons are analyzed from the aspects of administrative law enforcement mechanism of environmental management, operation and supervision of administrative law enforcement of environmental management in China. Through the effective cause analysis and looking at the whole world, this paper expounds the characteristics of the administrative law enforcement of environmental management in the United States and Japan, and analyzes the enlightenment brought to us by the advanced experience of the two countries. At the end of the article, the author strengthens the enforcement of environmental administrative law enforcement from the legislation of environmental protection in our country. In order to improve the construction and supervision mechanism of administrative law enforcement team of environmental management in China, this paper puts forward some solutions to the problems existing in the administrative law enforcement of environmental management in China, and summarizes the deficiencies of this paper.
