突發(fā)公共事件中政府信息公開(kāi)實(shí)例研究

【摘要】：近年來(lái)，突發(fā)公共事件接連發(fā)生，在關(guān)系到國(guó)家和人民生命、財(cái)產(chǎn)安全的緊急情況下，，面對(duì)程度和頻度逐漸嚴(yán)重的緊急態(tài)勢(shì)，政府信息公開(kāi)是我們必須思考的問(wèn)題。2007年和2008年我國(guó)相繼頒布了《突發(fā)事件應(yīng)對(duì)法》和《政府信息公開(kāi)條例》，是突發(fā)事件信息公開(kāi)法律上的保障，也對(duì)實(shí)踐的發(fā)展起到了舉足輕重的作用。但是，此制度本身和實(shí)踐方面并不是完美無(wú)缺。這一切表明，研究突發(fā)事件中的政府信息公開(kāi)顯得很有理論價(jià)值和現(xiàn)實(shí)意義。 本文主要結(jié)合“11·22”中石化東黃輸油管道泄漏爆炸事故，作為研究政府信息公開(kāi)方面的實(shí)例，研究分析了當(dāng)前在我國(guó)突發(fā)公共事件中政府信息公開(kāi)制度方面的不完善之處，并借鑒美國(guó)和日本在此方面的經(jīng)驗(yàn)，提出進(jìn)一步完善此制度的對(duì)策。
[Abstract]:In recent years, public emergencies have occurred one after another. In the emergency situation which relates to the life of the country and the people and the safety of property, the emergency situation of degree and frequency is becoming more and more serious. The disclosure of government information is a problem we must consider. In 2007 and 2008, China promulgated the Emergency response Law and the regulations on the publicity of Government Information, which is the legal guarantee for the disclosure of information about emergencies. It also plays an important role in the development of practice. However, the system itself and practice is not perfect. All this shows that the study of government information disclosure in emergencies is of great theoretical value and practical significance. Based on the leakage and explosion accident of "1122" Sinopec Donghuang oil pipeline, as an example of government information disclosure, this paper studies and analyzes the imperfections in the system of government information disclosure in the emergency public events in China. And draw lessons from American and Japanese experience in this respect, put forward the countermeasure that further consummates this system.
