【摘要】：就業(yè)平等權(quán)是高校畢業(yè)生在就業(yè)過程中所享有的就業(yè)機(jī)會(huì)、就業(yè)身份、就業(yè)規(guī)則等方面平等對(duì)待,以及基于特殊需要的合理的區(qū)別對(duì)待的權(quán)利。合理的區(qū)別對(duì)待的理由必須有充足的證據(jù)予以支持。當(dāng)前我國(guó)對(duì)高校畢業(yè)生就業(yè)平等權(quán)保護(hù)的立法不系統(tǒng)、不完整,法律適用性不強(qiáng)。保護(hù)大學(xué)生就業(yè)平等權(quán),應(yīng)當(dāng)完善相關(guān)法律,從就業(yè)歧視的認(rèn)定和判斷標(biāo)準(zhǔn)、舉證責(zé)任的方式和應(yīng)承擔(dān)的法律后果等方面進(jìn)行詳細(xì)的規(guī)定。
[Abstract]:The right to employment equality is the equal treatment of employment opportunities, employment status and employment rules enjoyed by college graduates in the process of employment, as well as the right to reasonable discrimination based on special needs. The grounds for reasonable discrimination must be supported by sufficient evidence. At present, the legislation on the protection of the equal right to employment of college graduates in China is not systematic and complete, and the applicability of the law is not strong. To protect the equal rights of college students in employment, we should perfect the relevant laws and make detailed provisions from the aspects of the recognition and judgment standard of employment discrimination, the way of burden of proof and the legal consequences that should be borne.
