論網(wǎng)絡(luò)論壇事前審查制度

【摘要】：網(wǎng)絡(luò)論壇是網(wǎng)民利用現(xiàn)代計(jì)算機(jī)網(wǎng)絡(luò)技術(shù)搭建的網(wǎng)上交流場所，俗稱BBS。它是一種計(jì)算機(jī)電子信息服務(wù)系統(tǒng)，向用戶提供了一塊公共信息發(fā)布白板，每個(gè)用戶都可以在上面發(fā)布各種信息或提出個(gè)人看法。大多數(shù)的大型網(wǎng)站都建有自己的BBS，供用戶和網(wǎng)民通過網(wǎng)絡(luò)來結(jié)交更多的朋友，表達(dá)更多的想法，并逐漸形成一種網(wǎng)絡(luò)化、信息化的虛擬社區(qū)。簡而言之，網(wǎng)絡(luò)論壇就是一個(gè)具有成熟社區(qū)所能提供服務(wù)內(nèi)容的大型規(guī)模性局域網(wǎng)絡(luò)信息交流平臺，涉及到政治、軍事、經(jīng)濟(jì)、民生、教育、娛樂、學(xué)術(shù)等各方面的綜合信息服務(wù)功能需求。 目前我國現(xiàn)行的《中華人民共和國計(jì)算機(jī)信息系統(tǒng)安全保護(hù)條例》、《互聯(lián)網(wǎng)信息服務(wù)管理辦法》、《互聯(lián)網(wǎng)上網(wǎng)服務(wù)營業(yè)場所管理?xiàng)l例》、《中華人民共和國電信條例》、《商用密碼管理?xiàng)l例》、《中國互聯(lián)網(wǎng)絡(luò)域名注冊暫行管理辦法》、《中共中央辦公廳、國務(wù)院辦公廳關(guān)于進(jìn)一步加強(qiáng)互聯(lián)網(wǎng)新聞宣傳和信息內(nèi)容安全管理工作的意見》和《中共中央辦公廳、國務(wù)院辦公廳關(guān)于進(jìn)一步加強(qiáng)互聯(lián)網(wǎng)管理工作的意見》等法律法規(guī)規(guī)定了國務(wù)院新聞辦公室、信息化工作辦公室、發(fā)展計(jì)劃委員會、通信管理、信息產(chǎn)業(yè)、公安、教育、衛(wèi)生、藥品監(jiān)督管理、文化、工商、新聞出版、廣電、國家安全部、國家保密局、海關(guān)、密碼管理機(jī)構(gòu)等十七個(gè)政府部門在信息網(wǎng)絡(luò)管理中的職權(quán)，其中對信息的審查占很重要的部分。 本文嘗試把我國現(xiàn)行的網(wǎng)絡(luò)論壇事前審查制度分為兩個(gè)主要部分，即是信息審查和身份審查，，對其特性、現(xiàn)狀和法理進(jìn)行探尋和研究。在此基礎(chǔ)上，嘗試研究審查制度的優(yōu)缺點(diǎn)，探討如何更好地保障公民網(wǎng)絡(luò)言論自由權(quán)利，以及尋求現(xiàn)行審查工作的真實(shí)目標(biāo)和所能起到的實(shí)際作用。
[Abstract]:Internet forum is an online exchange place built by Internet users using modern computer network technology, commonly known as BBS. It is a computer electronic information service system, which provides users with a public information release whiteboard, on which each user can publish various information or put forward personal views. Most large websites have their own BBS, for users and Internet users to make more friends, express more ideas, and gradually form a network, information virtual community. In short, an online forum is a large-scale local information exchange platform with content that mature communities can provide, involving politics, the military, the economy, people's livelihood, education, entertainment, Academic and other aspects of the comprehensive information services functional requirements. The current regulations of the people's Republic of China on the Security Protection of computer Information Systems, the regulations on the Administration of Internet Information Services, the regulations on the Administration of Business places for Internet Services, and the regulations of the people's Republic of China on Telecommunications, The regulations on the Administration of Commercial passwords, the interim measures for the Registration of Internet Domain names of China, the General Office of the CPC Central Committee, Opinions of the General Office of the State Council on further strengthening the work of Internet News propaganda and Security Administration of Information content, and the General Office of the CPC Central Committee, Opinions of the General Office of the State Council on further strengthening Internet Management, and other laws and regulations, such as the Information Office of the State Council, the Information work Office, the Development Planning Commission, the Communications Management, the Information Industry, Public Security, Education, Health, The functions and powers of 17 government departments in the management of information networks, such as drug supervision and administration, culture, industry and commerce, press and publication, radio and television, the Ministry of State Security, the State Security Bureau, the Customs, the password administration, etc. The examination of information is an important part of it. This paper attempts to divide the current network forum prior censorship system into two main parts, that is, information censorship and identity review, to explore and study its characteristics, current situation and jurisprudence. On this basis, this paper tries to study the merits and demerits of the censorship system, and discusses how to better protect the citizens' right to freedom of speech on the Internet, and to seek the true goal of the current censorship work and its practical role.
