【摘要】：伴隨著我國(guó)城市化進(jìn)程的加快,存量的城市國(guó)有土地已越來(lái)越不敷使用,國(guó)家通過(guò)行政手段征收農(nóng)村集體土地進(jìn)行城市化建設(shè)已成常態(tài)。這其中,由于補(bǔ)償與安置的形式、程序以及標(biāo)準(zhǔn)等原因,近幾年來(lái)發(fā)生過(guò)多起群體性事件,引發(fā)了人們的深思。作者試圖從上述幾個(gè)角度切入,對(duì)我國(guó)的農(nóng)村集體土地征收制度進(jìn)行分析,以此形成幾點(diǎn)政策建議。 論文的第一部分著重探析我國(guó)現(xiàn)行的集體土地征收制度,通過(guò)梳理了相關(guān)的法律法規(guī)和政策性文件,基本掌握了我國(guó)土地征收的法律脈絡(luò),并提出公共利益的判定以及征收補(bǔ)償?shù)臉?biāo)準(zhǔn)都值得商榷；論文的第二部分探究產(chǎn)生問(wèn)題的原因；第三部分則援引域外土地征收的制度設(shè)計(jì),以作比較和借鑒；第四部分提出了作者的政策建議,指出我國(guó)應(yīng)像出臺(tái)《國(guó)有土地上房屋征收與補(bǔ)償條例》一樣,出臺(tái)一部全國(guó)層面的《集體土地征收補(bǔ)償條例》,規(guī)范征收的標(biāo)準(zhǔn)、程序和補(bǔ)償?shù)姆峙�。并提出了作為配�?應(yīng)當(dāng)構(gòu)建農(nóng)民長(zhǎng)效增收機(jī)制,從而建立一套完整而又公平的集體土地征收制度。
[Abstract]:With the acceleration of urbanization in China, the stock of urban state-owned land has become more and more inadequate, and it has become the norm for the state to expropriate rural collective land for urbanization construction through administrative means. Due to the forms, procedures and standards of compensation and placement, many mass incidents have occurred in recent years, which has aroused people's deep thought. The author tries to analyze the rural collective land expropriation system from the above several angles, and form some policy suggestions. The first part of the paper focuses on the analysis of the current collective land expropriation system, through combing the relevant laws and regulations and policy documents, it basically grasps the legal context of land expropriation in China. And put forward the judgment of public interest and the standard of expropriation and compensation are open to question; The second part of the paper explores the causes of the problems, the third part refers to the extraterritorial land expropriation system design for comparison and reference; The fourth part puts forward the policy suggestions of the author, and points out that our country should, like "regulations on the Collection and compensation of Housing on State-owned Land", issue a national "regulations on compensation for Collective Land expropriation" and standardize the standards of expropriation. Distribution of procedures and compensation. The paper also puts forward that the farmers' long-term income increase mechanism should be set up as a supporting set, so as to establish a set of complete and fair collective land expropriation system.
