論機動車強制保險的立法模式——兼評《道路交通安全法》第76條

【摘要】:責任保險在交通事故受害人保護方面存在固有缺陷,不可抗力、過失相抵等抗辯事由阻礙受害人獲得及時、充分的保險賠付。無過失保險是在反思侵權(quán)責任制度缺陷的基礎(chǔ)上所作出的一項制度創(chuàng)新,但其廣泛的保護對象、寬松的賠付條件推高了保費支出,因此受到學界的質(zhì)疑和消費者的反對。修正的責任保險在保留責任保險三方結(jié)構(gòu)的同時,吸收了無過失保險的思想。通過弱化保險人的抗辯事由、放寬保險賠付要件,修正的責任保險可以達到強化保護交通事故受害人之目標。我國《道路交通安全法》第76條采納了修正的責任保險模式,此種模式最能契合我國機動車強制保險為交通事故受害人提供基本保障之立法目的,因此在制度構(gòu)造上優(yōu)于傳統(tǒng)的責任保險模式。
[Abstract]:Liability insurance has inherent defects in the protection of traffic accident victims, such as force majeure, fault offset and other defenses that prevent the victim from obtaining timely and adequate insurance compensation. The no-fault insurance is a system innovation on the basis of reflecting on the defects of tort liability system, but its extensive object of protection and the loose conditions of indemnity push up the premium expenditure, so it is questioned by academic circles and opposed by consumers. The modified liability insurance absorbs the idea of no-fault insurance while retaining the tripartite structure of liability insurance. By weakening the defense of the insurer and relaxing the requirements of insurance indemnity, the amended liability insurance can strengthen the protection of the victims of traffic accidents. Article 76 of our country's Road Traffic Safety Law adopts the amended liability insurance model, which is most suitable for the legislative purpose of compulsory motor vehicle insurance to provide basic protection for the victims of traffic accidents. Therefore, the system structure is superior to the traditional liability insurance model.
