【摘要】：當(dāng)前基層社會治理中,不斷出現(xiàn)群體性涉法鬧訪事件。原本應(yīng)由司法機(jī)關(guān)或法定行政機(jī)關(guān)處理的案件,卻通過群體聚集的方式向黨政機(jī)關(guān)抗議以圖解決,將案件演變?yōu)槭录�。黨政機(jī)關(guān)的主政官員在社會穩(wěn)定效用函數(shù)的制約之下,借助其綜合協(xié)調(diào)能力和財政調(diào)撥權(quán)力迅速處理事件并給予補(bǔ)償,把事件轉(zhuǎn)化為案件。運(yùn)動式執(zhí)法的背后是博弈的結(jié)果。當(dāng)事人通過群體鬧訪參與了博弈競爭,介入了主政官員與上級機(jī)關(guān)的長期博弈關(guān)系中,改變了主政官員的支付函數(shù),當(dāng)事人實現(xiàn)了利益訴求。這一維穩(wěn)機(jī)制具有制度的自毀性,破壞了基層法治,向外界釋放了政府權(quán)力商品化的信息。因此,需要改革基層治理綜合評價指標(biāo),重塑科層強(qiáng)激勵;吸納公眾參與危機(jī)事件治理,營造黨政系統(tǒng)的符號資本;疏通商談渠道,實現(xiàn)訪民的分類與社區(qū)治理制度的完善。
[Abstract]:At present, social governance at the grassroots level, there are group-related law-related incidents. The cases that should be handled by the judicial or statutory administrative organs, however, protest to the Party and government organs in the form of group gathering in order to resolve the case, and turn the case into an event. Under the restriction of the social stability utility function, the principal and government officials of the Party and government organs, with the help of their comprehensive coordination ability and financial transfer power, deal with the incident quickly and give compensation, so as to transform the incident into a case. The result of game is behind the law enforcement. The parties involved in the game competition through group visits, involved in the long-term game relationship between the principal officials and the higher authorities, changed the payment function of the political officials, and realized the interests of the parties. This stability mechanism has the self-destruction of the system, destroys the grass-roots rule of law, and releases the information of the commercialization of government power to the outside world. Therefore, it is necessary to reform the comprehensive evaluation index of grass-roots governance, to reshape the strong incentives of departments, to absorb the public to participate in crisis management, to construct the symbolic capital of the party and government system, to dredge the channels of negotiation, and to realize the classification of visiting people and the perfection of community governance system.
