【摘要】：近幾年來,我國計劃生育政策頻繁調(diào)整,計劃生育政策與法律、法規(guī)之間的矛盾不斷顯現(xiàn)。這引發(fā)了學(xué)界對生育權(quán)保障問題的進一步思考。本文分析我國生育權(quán)保障現(xiàn)狀,并指出其存在的缺陷。立法機關(guān)以突出強調(diào)計劃生育義務(wù)的思路來制定憲法與計劃生育法律、法規(guī),生育權(quán)保障圍繞計劃生育義務(wù)的履行設(shè)定的。計劃生育政策與法律、法規(guī)之間的激烈沖突關(guān)系導(dǎo)致生育權(quán)保障法治化不完善。針對問題,建議我國完善憲政制度來保障生育權(quán),行政權(quán)限制,協(xié)調(diào)計劃生育政策與法律、法規(guī)的關(guān)系。明確計劃生育政策與法律、法規(guī)之間的效力位階,計劃生育政策作引導(dǎo),法律、法規(guī)作依據(jù)。法律、法規(guī)占有應(yīng)有的位置,計劃生育政策回歸到政策原有的位置,兩者有機結(jié)合建立合理有效的生育權(quán)保障制度。在此基礎(chǔ)上對憲法和《人口與計劃生育法》等提出合理、科學(xué)的修改意見,完善生育權(quán)的憲法保障和部門法保障。
[Abstract]:In recent years, China's family planning policy frequent adjustment, family planning policy and laws, laws and regulations between the contradictions continue to appear. This has caused the academic circles to the reproductive right safeguard question further ponder. This paper analyzes the present situation of the protection of reproductive rights in China, and points out its defects. The legislature formulates the constitution and family planning laws, regulations and reproductive rights around the fulfillment of family planning obligations by highlighting the idea of family planning obligations. The fierce conflict between the family planning policy and the laws and regulations leads to the imperfection of the rule of law for the protection of reproductive rights. In view of the problems, it is suggested that our country should perfect the constitutional system to protect the right of birth and the restriction of administrative power, and to coordinate the relationship between family planning policy and laws and regulations. Make clear family planning policy and law, the effective rank between regulations, family planning policy as guidance, laws and regulations as the basis. Laws and regulations occupy due position, family planning policy returns to the original position of the policy, and the two combine organically to establish a reasonable and effective reproductive right protection system. On this basis, reasonable and scientific amendments to the Constitution and the population and Family Planning Law are put forward to improve the constitutional and departmental protection of reproductive rights.
