【摘要】：本文研究了重慶梁平縣及寧夏平羅縣農(nóng)民承包地有償退出的運行制度,重點從制度生成、退地條件、參與主體、補償標(biāo)準(zhǔn)、資金來源、退出形式、土地利用、保障制度等方面進(jìn)行了比較分析;并就"平羅模式"和"梁平模式"退地制度的缺陷——政府收儲制度、退地農(nóng)民落戶制度、承包地抵押制度及承包地價值評估制度存在不足,以及"農(nóng)遷農(nóng)"落戶制度、退地制度中主體糾紛隱患進(jìn)行了討論;最后針對兩種退地制度缺陷,分別提出了對策建議。
[Abstract]:This paper studies the operating system of compensation withdrawal of farmers' contracted land in Liangping County of Chongqing and Pingluo County of Ningxia, focusing on the formation of the system, the conditions of returning land, the main body of participation, the standard of compensation, the source of funds, the form of withdrawal, the land use. The security system is compared and analyzed. The defects of "Pingluo Model" and "Liangping Mode" in the system of land retreat, such as the system of government collection and storage, the system of setting up residence for peasants, the system of mortgage on contracted land and the system of evaluating the value of contracted land, and the system of setting up residence in rural areas are also discussed. The hidden trouble of subject dispute in the system of land retreat is discussed. Finally, aiming at the defects of the two kinds of land retreating system, the countermeasures and suggestions are put forward respectively.
