【摘要】：本文主要研究了機(jī)動(dòng)車貶值損失的一些法律問(wèn)題,主要圍繞著交通事故中機(jī)動(dòng)車貶值損失該不該賠償以及該如何賠償這兩個(gè)問(wèn)題展開(kāi)論述。最終的觀點(diǎn)是道路交通是故中的機(jī)動(dòng)車貶值是應(yīng)該賠償?shù)?并且從實(shí)踐的角度給出了如何賠償?shù)囊恍┙ㄗh。以下是本文的主要內(nèi)容： 引言,簡(jiǎn)單的介紹一下我國(guó)機(jī)動(dòng)車貶值損失賠償?shù)谋尘昂鸵饬x,相關(guān)的文獻(xiàn)綜述,論文使用的研究方法以及論文的基本思路和邏輯結(jié)構(gòu) 第一章,主要從三個(gè)方面來(lái)闡述機(jī)動(dòng)車貶值損失賠償?shù)南嚓P(guān)理論,這三個(gè)方面分別是機(jī)動(dòng)車貶值損失的性質(zhì)、公平原則以及全面賠償原則。目的是想說(shuō)明機(jī)動(dòng)車貶值損失是客觀的直接損失,對(duì)其進(jìn)行賠償符合我國(guó)民法理論中的公平原則和全面賠償原則,借此進(jìn)一步引申機(jī)動(dòng)車貶值損失賠償時(shí)具有相關(guān)理論基礎(chǔ)的。 第二章,主要是論述機(jī)動(dòng)車貶值損失賠償在司法實(shí)踐中的現(xiàn)實(shí)狀況,其中分別對(duì)各級(jí)法院的意見(jiàn)、各地法院的認(rèn)定標(biāo)準(zhǔn)以及對(duì)法院不支持機(jī)動(dòng)車貶值損失賠償理由的分析與反思。目的是通過(guò)論述司法實(shí)踐中,機(jī)動(dòng)車貶值損失賠償引起爭(zhēng)議的原因有哪些,然后通過(guò)對(duì)于原因的分析來(lái)從反面說(shuō)明機(jī)動(dòng)車貶值損失賠償在司法實(shí)踐中是可行的。第二章和第一章相結(jié)合,就希望能夠從理論和實(shí)踐兩方面說(shuō)明機(jī)動(dòng)車貶值損失賠償是應(yīng)當(dāng)支持的。 第三章,主要是論述該如何去進(jìn)行機(jī)動(dòng)車貶值損失的賠償,也就是怎樣構(gòu)建機(jī)動(dòng)車貶值損失賠償制度。該章節(jié)分為三個(gè)部分,第一個(gè)部分是闡述了國(guó)外關(guān)于機(jī)動(dòng)車貶值損失賠償?shù)乃痉▽?shí)踐,目的是考慮是否能夠從中借鑒一些經(jīng)驗(yàn)；第二部分是構(gòu)建機(jī)動(dòng)車貶值損失賠償制度的意義,也就是說(shuō)明該制度構(gòu)建的重要性；第三部分寫的是具體構(gòu)建中的一些想法,就是應(yīng)該在構(gòu)建機(jī)動(dòng)車貶值損失賠償制度時(shí)應(yīng)注意或者考慮的因素。
[Abstract]:This paper mainly studies some legal problems of the devaluing loss of motor vehicles, mainly focusing on the two problems of whether or not to compensate for the devaluing loss of motor vehicles in traffic accidents and how to compensate them. The final point of view is that the depreciation of motor vehicles in road traffic should be compensated, and some suggestions on how to compensate are given from the point of view of practice. The following is the main content of this paper: introduction, a brief introduction to the background and significance of China's motor vehicle depreciation loss compensation, relevant literature review, The research methods used in the paper, as well as the basic ideas and logical structure of the thesis Chapter one, mainly from three aspects to explain the relevant theory of motor vehicle depreciation loss compensation, these three aspects are the nature of vehicle depreciation loss. The principle of fairness and the principle of full compensation. The purpose is to explain that the devaluing loss of motor vehicle is an objective direct loss, and the compensation accords with the fair principle and the overall compensation principle in the theory of civil law of our country, and it has the relevant theoretical foundation to further extend the compensation for the devaluing loss of the motor vehicle. The second chapter mainly discusses the actual situation of the compensation for vehicle depreciation loss in the judicial practice, in which the opinions of the courts at all levels are respectively discussed. The standards of the courts and the reasons why the courts do not support the devaluing loss of motor vehicles. The purpose of this paper is to discuss the reasons why the compensation for motor vehicle depreciation loss has caused controversy in judicial practice, and then through the analysis of the reasons to show that the compensation for motor vehicle depreciation loss is feasible in judicial practice. Combining the second chapter and the first chapter, the author hopes to prove that the compensation for motor vehicle depreciation loss should be supported in theory and practice. The third chapter, mainly discusses how to carry on the vehicle depreciation loss compensation, namely how to construct the vehicle depreciation loss compensation system. This chapter is divided into three parts, the first part is to elaborate the foreign judicial practice of compensation for vehicle depreciation loss, the purpose is to consider whether we can learn from some experience; The second part is the significance of constructing the compensation system of vehicle depreciation loss, that is, the importance of the construction of the system; The third part is about some thoughts in the concrete construction, that is, the factors that should be paid attention to or taken into account in the construction of vehicle depreciation compensation system.
