【摘要】：科技引領(lǐng)生活，新科技革命的浪潮席卷全球每一處角落；科技重構(gòu)世界，現(xiàn)代科技發(fā)展水平和層次的高低，直接決定一個國家在國際舞臺上的地位和分量，正如鄧小平同志精辟闡述的那樣：科學(xué)技術(shù)不僅是生產(chǎn)力，而且是第一生產(chǎn)力。 在新科技革命大環(huán)境大背景之下，從國家發(fā)展、社會進(jìn)步到公民個人生活都發(fā)生了重大變化，社會結(jié)構(gòu)、社會階層也隨之發(fā)生質(zhì)的變動，新科技革命催生的各種新生事物，使得社會生活更加復(fù)雜和多變。作為“物質(zhì)基礎(chǔ)”的“客觀世界”變化必然會促使作為“上層建筑”的“法律制度”做出相應(yīng)的調(diào)整和改變。法律只有以其靈活性和適應(yīng)性呈現(xiàn)，才能滿足處于不斷變化中的、紛繁復(fù)雜的社會的需要�？萍挤ㄖ平ㄔO(shè)的興起和發(fā)展，是科技發(fā)展的需求和結(jié)果，也是法律不斷自我完善的內(nèi)在表現(xiàn)�？萍嫉娜招略庐惒粩嗟慕o法律提出新的問題和挑戰(zhàn)，，如何有效減輕法律的滯后性給科技發(fā)展帶來的不良影響？如何建立健全更科學(xué)合理的法律體系、法律制度為科技發(fā)展披荊斬棘、保駕護(hù)航？現(xiàn)代科技的璀璨成果又如何為法律自身的突破和成熟發(fā)揮作用？這些都是非常值得深入研究和探討的重大課題。
