【摘要】：近幾年,植物新品種權(quán)許可使用中的侵權(quán)案件、權(quán)屬糾紛案件逐漸增多,相當(dāng)多的維權(quán)人由于訴訟敗訴而蒙受巨大經(jīng)濟(jì)損失。以3個(gè)較為典型的玉米品種權(quán)糾紛案件為對(duì)象,分析案例所反映的品種權(quán)申請(qǐng)、保護(hù)、風(fēng)險(xiǎn)防控、價(jià)值評(píng)估和維權(quán)等問(wèn)題,提出相應(yīng)的解決辦法和建議,為權(quán)利人維護(hù)自身權(quán)益和規(guī)避法律風(fēng)險(xiǎn)提供參考。
[Abstract]:In recent years, the infringement cases in the use of new plant variety rights have gradually increased, and quite a number of rights defenders have suffered huge economic losses due to the loss of litigation. Taking three typical cases of maize variety rights dispute as the object, this paper analyzes the application for variety rights, protection, risk prevention and control, value evaluation and rights protection, and puts forward the corresponding solutions and suggestions, which are reflected in the cases, such as application for variety rights, protection, risk prevention and control, value evaluation and protection of rights, and so on. For the obligee to protect their own rights and interests and avoid legal risks to provide a reference.
