【摘要】：我國現(xiàn)行"集體所有,農(nóng)戶承包"的"兩權(quán)分離"農(nóng)村土地制度,盡顯其無法滿足城鎮(zhèn)化需求的土地流轉(zhuǎn)僵化性。土地所有權(quán)、承包權(quán)、經(jīng)營權(quán)"三權(quán)分置"的構(gòu)想,缺乏相應的經(jīng)營權(quán)法律制度配套,阻礙了現(xiàn)實中土地的有效流轉(zhuǎn)。"三權(quán)分置"的農(nóng)村土地權(quán)利法律制度構(gòu)建,重心在于農(nóng)村土地經(jīng)營權(quán)的法律邏輯結(jié)構(gòu)與現(xiàn)實國情,將土地經(jīng)營權(quán)從承包權(quán)中獨立出來,構(gòu)造物權(quán)化和債權(quán)化并置的二元農(nóng)村土地經(jīng)營權(quán)制度。法律上明確,經(jīng)過登記公示的為物權(quán)性土地經(jīng)營權(quán),未登記公示的為債權(quán)性土地經(jīng)營權(quán)。
[Abstract]:The current rural land system of "collective ownership and peasant household contracting" shows the rigidity of land circulation which can not meet the needs of urbanization. The conception of land ownership, contract right and management right as "three rights are divided" lacks the corresponding legal system of management right, which hinders the effective circulation of land in reality. " The construction of the legal system of rural land rights based on the separation of three rights focuses on the legal logic structure of the rural land management right and the actual national conditions, which makes the land management right independent from the contract right. Construct dual system of land management right of rural land which is juxtaposed with real right and creditor's right. It is clear in law that the registered land management right is real right, and the unregistered land management right is creditor's right.
