【摘要】：為充分保障病人醫(yī)療自主權(quán),臺(tái)灣地區(qū)新立"病人自主權(quán)利法"。該法以病人醫(yī)療自主、善終、醫(yī)患和諧為基本理念,使病人在無決定能力時(shí)仍能實(shí)現(xiàn)自主權(quán)并賦予優(yōu)先知情決定權(quán),采用尊嚴(yán)死的善終模式,允許病人拒絕維生醫(yī)療,同時(shí)也關(guān)注醫(yī)患關(guān)系,維護(hù)醫(yī)療專業(yè)自主。該法建立了預(yù)立醫(yī)療決定制度,病人可以通過預(yù)立醫(yī)療照護(hù)咨商,與醫(yī)療人員及家屬充分溝通后,簽署預(yù)立醫(yī)療決定,就接受或拒絕維生醫(yī)療做出選擇。該法對(duì)我國(guó)大陸衛(wèi)生法制具有諸多啟示,包括應(yīng)明確病人自己決定與家屬代行決定的關(guān)系,區(qū)分拒絕維生醫(yī)療權(quán)與安樂死、醫(yī)助自殺,賦予預(yù)先醫(yī)療指示法律效力,兼顧國(guó)家利益和醫(yī)療服務(wù)者權(quán)利。
[Abstract]:In order to fully safeguard the patient's medical autonomy, the Taiwan area newly enacted the patient's Autonomy right Act. This law is based on the principle of patient's medical autonomy, hospice and doctor-patient harmony. It enables patients to realize their autonomy and give priority to informed decision when they have no ability to decide, and adopts the mode of death with dignity, which allows patients to refuse to maintain their medical care. At the same time also pay attention to the relationship between doctors and patients, and maintain the autonomy of medical professionals. The Act establishes a system of pre-established medical decisions, whereby patients may, through consultation with pre-established medical care, fully communicate with medical staff and their families, sign pre-established medical decisions and make choices about accepting or refusing subsistence care. The law has many implications for the health legal system in mainland China, including clarifying the relationship between the patient's own decision and his family's decision, distinguishing the right to refuse medical care from euthanasia, medical aid for suicide, and giving legal effect to advance medical instructions. Take into account the interests of the State and the rights of medical service providers.
