【摘要】：就活體器官移植而言,識別變相買賣人體器官的情形并加以防范,是亟待研究的重要課題。在活體器官移植中,人體器官買賣可能發(fā)生在非親屬之間,也可能發(fā)生在親屬之間。非親屬間的器官買賣主要表現(xiàn)為假冒親屬關(guān)系以及非法地下器官移植。親屬間器官買賣的主要情形是通過物質(zhì)利益誘導(dǎo)供者捐獻。防范人體器官變相買賣的措施有:將參與人體器官買賣的中介及醫(yī)療機構(gòu)納入刑法調(diào)整的對象;規(guī)范醫(yī)務(wù)人員診療活動,嚴(yán)懲器官買賣涉案人員;凈化網(wǎng)絡(luò),鏟除非法器官交易滋生的環(huán)境;切實提高醫(yī)院倫理委員會的審查能力;提高公眾生命意識,珍視生命。
[Abstract]:As far as living organ transplantation is concerned, it is an important issue to identify and prevent the disguised sale of human organs. In living organ transplantation, the sale of human organs may occur between non-relatives or between relatives. The sale of organs between non-relatives is mainly manifested by fake kinship and illegal underground. Organ transplantation.The main situation of organ trading among relatives is to induce donors to donate through material benefits.The measures to prevent the disguised trading of human organs include: putting intermediaries and medical institutions involved in the trading of human organs into the object of criminal law adjustment; regulating medical staff's diagnostic and therapeutic activities; severely punishing those involved in organ trading; purifying the network and eliminating illegal activities. The environment in which organ trade breeds, the examination ability of the ethical committee of the hospital, the public awareness of life and the value of life should be enhanced.
