【摘要】：在未成年人成長過程中，有大部分的時間將在校園中作為一個學(xué)生度過，所以在這個階段為未成年人的學(xué)生的身心健康，受教育的權(quán)利，個人隱私及其他合法權(quán)益提供有效的保護就顯得尤為重要。中學(xué)生是未成年學(xué)生的一個重要群體，學(xué)校作為初、高中學(xué)生受教育的主要場所，為他們的成長和學(xué)習(xí)提供良好的物質(zhì)和精神環(huán)境，其重任義不容辭。因此，應(yīng)采取措施保護中學(xué)生在校期間的權(quán)益。 本文分共分了四大部分來論述：一、概述了中學(xué)生在校期間權(quán)益保護的相關(guān)概念和理論；二、分析了當(dāng)前我國中學(xué)生在校期間權(quán)益保護的現(xiàn)狀，包括介紹有關(guān)的法律體系、我國法律對中學(xué)生學(xué)校保護的法律要求以及當(dāng)前中學(xué)生在校期間權(quán)益遭受侵害的總體特征；三、分析了保護中學(xué)生在校期間權(quán)益中存在的主要問題，并分別從政府，學(xué)校，教師和初高中學(xué)生的角度分析他們問題的原因，，并針對原因給出了加強我國在校中學(xué)生權(quán)益保護的對策；四、為結(jié)論和展望。 希望本文的分析能為當(dāng)前我國中學(xué)生在校期間的權(quán)益保護問題的認(rèn)識和實踐操作給出一定的理論借鑒和實踐參考。
[Abstract]:As minors grow up, most of the time will be spent on campus as a student, so at this stage for the minor's physical and mental health, the right to education, Personal privacy and other legitimate rights and interests to provide effective protection is particularly important. Middle school students are an important group of underage students. As the main place for high school students to receive education, it is incumbent on them to provide a good material and spiritual environment for their growth and study. Therefore, measures should be taken to protect the rights and interests of middle school students. This paper is divided into four parts: first, it summarizes the related concepts and theories of the protection of the rights and interests of the middle school students in school; secondly, it analyzes the current situation of the protection of the rights and interests of the middle school students in our country, including the introduction of the relevant legal system. The legal requirements for the school protection of middle school students in our country and the overall characteristics of the infringement of the rights and interests of the middle school students during the school period. Thirdly, the main problems in the protection of the rights and interests of the middle school students during the school period are analyzed, and respectively from the government, the school, This paper analyzes the causes of their problems from the angle of teachers and junior high school students, and puts forward the countermeasures to strengthen the protection of the rights and interests of middle school students in our country. It is hoped that the analysis of this paper can provide some theoretical and practical references for the understanding and practical operation of the protection of the rights and interests of middle school students in our country.
