【摘要】：通過分析748件涉及危險(xiǎn)廢物的環(huán)境行政處罰案例,研究了中國(guó)與危險(xiǎn)廢物相關(guān)的違反環(huán)境行政處罰案例的特征,為涉及危險(xiǎn)廢物的行業(yè)自律及政府監(jiān)管提供參考。結(jié)果表明,經(jīng)濟(jì)發(fā)達(dá)地區(qū)的案例數(shù)量遠(yuǎn)多于欠發(fā)達(dá)地區(qū),涉及最多的危險(xiǎn)廢物種類為HW49其他廢物,從危險(xiǎn)廢物的產(chǎn)生到利用和處置全過程都有相關(guān)案例發(fā)生,化學(xué)原料和化學(xué)制品制造業(yè)是案例高發(fā)行業(yè),當(dāng)前多以0~2萬元的小額罰款為主。在案例特征分析的基礎(chǔ)上,提出了相關(guān)建議。
[Abstract]:By analyzing 748 cases of environmental administrative punishment related to hazardous wastes, this paper studies the characteristics of environmental administrative penalties related to hazardous wastes in China, and provides a reference for self-discipline and government supervision of hazardous wastes. The results show that the number of cases in the economically developed areas is much more than that in the less developed areas, and the most hazardous wastes involved are other wastes of HW49, which are related to the whole process from the generation of hazardous wastes to the use and disposal of hazardous wastes. Chemical raw materials and chemical products manufacturing is a case-high-incidence industry, most of the current small fines of 0-20, 000 yuan. Based on the analysis of case characteristics, some suggestions are put forward.
