【摘要】：《中華人民共和國促進(jìn)科技成果轉(zhuǎn)化法》是我國地方促進(jìn)科技成果轉(zhuǎn)化條例制定的上位法依據(jù)。山東、山西、甘肅以及安徽四省都制定了各自的促進(jìn)科技成果轉(zhuǎn)化條例,并根據(jù)上位法的規(guī)定而設(shè)置了本省的促進(jìn)職務(wù)科技成果轉(zhuǎn)化的獎(jiǎng)勵(lì)機(jī)制,然而這四省的法律文本中關(guān)于獎(jiǎng)勵(lì)機(jī)制的設(shè)置存在著諸如合法性困境、可操作性困難以及立法技術(shù)不完善的問題。如此,山東、山西、甘肅、安徽應(yīng)當(dāng)及時(shí)啟動(dòng)本省的促進(jìn)科技成果轉(zhuǎn)化條例的修訂工作,同時(shí)在獎(jiǎng)勵(lì)機(jī)制的設(shè)置上如授獎(jiǎng)主體、受獎(jiǎng)主體、獎(jiǎng)勵(lì)程序、獎(jiǎng)勵(lì)標(biāo)準(zhǔn)等結(jié)合新修訂的上位法作出更加完善的規(guī)定,以促進(jìn)與鼓勵(lì)地方的職務(wù)科技成果能夠順利轉(zhuǎn)化為現(xiàn)實(shí)的生產(chǎn)力。
[Abstract]:The Law of the people's Republic of China on promoting the Transformation of Scientific and technological achievements is the upper law basis of the local regulations on promoting the Transformation of Scientific and technological achievements in China. Four provinces, Shandong, Shanxi, Gansu and Anhui, have formulated their own regulations to promote the transformation of scientific and technological achievements, and have set up their own incentive mechanisms to promote the transformation of scientific and technological achievements in their posts in accordance with the provisions of the superior law. However, in the legal texts of these four provinces, there are some problems such as legitimacy dilemma, maneuverability difficulties and imperfect legislative techniques. In this way, Shandong, Shanxi, Gansu, and Anhui should promptly start the revision of the regulations on promoting the Transformation of Scientific and technological achievements in this province, and at the same time, in the setting up of the reward mechanism, such as the awarding subject, the recipient of the award, and the reward procedure, The reward standard and so on combine with the newly revised superior law to make the more perfect stipulation, in order to promote and encourage the local position science and technology achievement to transform smoothly into the actual productivity.
