【摘要】：運(yùn)用文獻(xiàn)資料法等在教育公平視野下對我國學(xué)校體育立法進(jìn)行思考。闡明學(xué)校體育立法的必要性和重要性。從教育公平基本國策和學(xué)校體育公平缺失現(xiàn)象兩方面論述《學(xué)校體育法》"公平"立法取向的重要價值。教育公平視閾下《學(xué)校體育法》的條文擬定應(yīng)涵蓋:明確體育權(quán)利,實(shí)現(xiàn)公平的立法目的和指導(dǎo)思想;嚴(yán)守學(xué)校體育教育起點(diǎn)公平、積極推動過程和結(jié)果公平;兩性平權(quán),弱勢補(bǔ)償,學(xué)校體育地位確立和體育教師地位平等,問責(zé)條例等公平性要素。建議:加速條文研擬和組織機(jī)構(gòu)設(shè)立,強(qiáng)化管理主體和立法者緊迫意識,加大普法與宣傳力度等,通過"普法"與"制法"的雙行線推動學(xué)校體育立法的實(shí)現(xiàn)。
[Abstract]:Using the method of literature and materials, the author thinks about the legislation of school physical education in our country from the perspective of educational equity. This paper expounds the necessity and importance of school sports legislation. This paper discusses the important value of the "fair" legislative orientation of "School physical Education Law" from two aspects: the basic state policy of educational fairness and the lack of equity in school physical education. The formulation of the provisions of the School physical Education Law under the perspective of educational equity should cover: making clear the right to sports, realizing the legislative purpose and guiding ideology of fairness; strictly observing the equity of the starting point of school physical education, actively promoting the process and result equity, and equal rights of both sexes, Vulnerable compensation, the establishment of school sports status and the equal status of PE teachers, accountability regulations and other elements of fairness. Suggestions: to accelerate the drafting of articles and the establishment of organization, to strengthen the urgent consciousness of the main body of management and legislators, to increase the popularization of law and publicity, and to promote the realization of school physical education legislation through the double line of "law popularization" and "law making".
