【摘要】：當下民間糾紛呈現(xiàn)出日益增多且復雜化的趨勢,一旦處理不當,可能引發(fā)刑事案件,如何適時化解民間糾紛成為社會治理的一個難題。警察權(quán)作為一種維護社會治安秩序的國家權(quán)力,它的介入能有效阻斷民間糾紛轉(zhuǎn)換路徑,防止其演變?yōu)榉缸?因此有必要承擔起糾紛處理的重任。然而,法律規(guī)范對民間糾紛的模糊界定致使警察權(quán)介入頻繁失度,相反警察權(quán)介入糾紛過程中過度限縮又極易引起救助失位,進而釀成惡性沖突事件。因此,有必要在明晰警察權(quán)介入限度的基礎上,對其介入方式進行適當延伸,以走出失度與失位的困境。
[Abstract]:At present, civil disputes are increasingly increasing and complicated. Once handled improperly, it may lead to criminal cases. How to resolve civil disputes in good time has become a difficult problem of social governance. Police power as a state power to maintain public order, its intervention can effectively block the transition path of civil disputes, prevent them from turning into crimes, so it is necessary to assume the heavy responsibility of dispute resolution. However, the fuzzy definition of civil disputes in legal norms leads to the frequent loss of police power intervention. On the contrary, excessive limitation of police power intervention in the process of disputes can easily lead to the loss of relief, which leads to malignant conflict events. Therefore, it is necessary to make proper extension of the intervention mode on the basis of clarifying the limit of the intervention of police power, so as to get out of the dilemma of losing degree and place.
