【摘要】：結(jié)合中國生物入侵之現(xiàn)狀,借鑒國內(nèi)外的先進經(jīng)驗及立法規(guī)制,對中國防治生物入侵所存在的主要問題及現(xiàn)行立法、政策進行全面且深入的分析,指出對外來生物應(yīng)采取綜合治理機制,加強外來生物防治與管理立法之可操作性及其與對外貿(mào)易法、刑法等各部門立法之間的協(xié)調(diào),并在現(xiàn)行政策、立法基礎(chǔ)之上制定綜合性的生物入侵防治與管理法,確立風(fēng)險評估與風(fēng)險預(yù)防原則等各項法律制度。
[Abstract]:Combined with the current situation of biological invasion in China, the main problems existing in the prevention and control of biological invasion in China and the current legislation and policies are comprehensively and deeply analyzed by referring to the advanced experience and legislative regulation at home and abroad. It is pointed out that the comprehensive management mechanism should be adopted to strengthen the operability of the legislation on the prevention and management of alien organisms and the coordination with the legislation of foreign trade law, criminal law and other departments, and the existing policies. On the basis of legislation, the comprehensive biological intrusion prevention and management law is formulated, and various legal systems such as risk assessment and risk prevention principles are established.
