【摘要】：全國(guó)人大及其常委會(huì)對(duì)監(jiān)察委員會(huì)應(yīng)有立法權(quán),各級(jí)人大及其常委會(huì)對(duì)同級(jí)監(jiān)察委員會(huì)成員應(yīng)有任免權(quán),對(duì)其工作應(yīng)有監(jiān)督權(quán)。中央監(jiān)察委員會(huì)主任應(yīng)由全國(guó)人大選舉(而非決定)產(chǎn)生,即提名人屬于人大主席團(tuán)(而非國(guó)家主席)。在憲法規(guī)定的人民法院、人民檢察院和公安機(jī)關(guān)辦理刑事案件的原則條文中,應(yīng)增加監(jiān)察機(jī)關(guān)。由于我國(guó)監(jiān)察機(jī)關(guān)的性質(zhì)接近行政權(quán),因此,監(jiān)察權(quán)應(yīng)納入行政訴訟范疇;許多國(guó)家對(duì)涉及人身和財(cái)產(chǎn)的調(diào)查權(quán)需經(jīng)法院審查和批準(zhǔn),這值得我們借鑒。檢察機(jī)關(guān)的監(jiān)督對(duì)象應(yīng)由過(guò)去的監(jiān)督公安、法院、監(jiān)獄等延伸至監(jiān)察機(jī)關(guān),為此,檢察院應(yīng)保留批準(zhǔn)逮捕權(quán),對(duì)監(jiān)察委員會(huì)違法行為的糾正權(quán),對(duì)其移送案件的審查權(quán)等。
[Abstract]:The NPC and its standing Committee shall have legislative power over the supervisory committee, and the people's congresses and their standing committees at all levels shall have the power to appoint and remove members of the supervisory committee at the same level and to supervise their work. The director of the Central Supervisory Committee shall be elected by the National people's Congress (not by decision), that is, the nominees shall belong to the Presidium of the National people's Congress (not the chairman of the state). The people's court, the people's procuratorate and the public security organ should increase the supervisory organ in the principle of handling criminal cases in the people's court, the people's procuratorate and the public security organ. Since the nature of the supervisory organ in our country is close to that of the administrative power, the supervisory power should be brought into the scope of administrative litigation, and many countries need to be examined and approved by the court for the right of investigation involving persons and property, which is worthy of our reference. The supervisory object of the procuratorial organ should be extended from the public security supervision, the court, the prison and so on to the supervisory organ. For this reason, the procuratorate should retain the power to approve the arrest, correct the illegal act of the supervisory committee, and examine the case transferred to the procuratorate.
