【摘要】：近些年來(lái)醫(yī)療糾紛頻發(fā)，患方暴力擾亂醫(yī)療秩序行為不斷增多，并且惡性程度愈加嚴(yán)重，據(jù)衛(wèi)生部統(tǒng)計(jì)數(shù)據(jù)稱近年來(lái)全國(guó)發(fā)生醫(yī)鬧事件20000多起,比五年前多了近三分之一,2014年擾亂醫(yī)療秩序行為的事件截止目前已發(fā)生多起，2013年共有28次，2012年有26次。 面對(duì)正常的醫(yī)療秩序被嚴(yán)重威脅，2012年4月30日衛(wèi)生部、公安部聯(lián)合發(fā)出《關(guān)于維護(hù)醫(yī)療機(jī)構(gòu)秩序的通告》，就加強(qiáng)醫(yī)療機(jī)構(gòu)安全管理提出了新的要求，提出了新的法制保障。2014年3月總理在政府工作報(bào)告中指出，仍要繼續(xù)開展以公立醫(yī)院改革為主旋律的醫(yī)療改革。2014年4月，最高人民法院、最高人民檢察院、公安部、司法部、國(guó)家衛(wèi)生和計(jì)劃生育委員會(huì)經(jīng)深入調(diào)查研究，廣泛征求意見(jiàn)，制定了《關(guān)于依法懲處涉醫(yī)違法犯罪維護(hù)正常醫(yī)療秩序的意見(jiàn)》，，為依法懲處涉醫(yī)違法犯罪，維護(hù)正常醫(yī)療秩序，構(gòu)建和諧醫(yī)患關(guān)系給予了強(qiáng)有力的司法保障。 本文通過(guò)對(duì)發(fā)生擾亂醫(yī)療秩序的案例進(jìn)行歸納分析，明確產(chǎn)生的原因及社會(huì)危害性，對(duì)主要擾亂醫(yī)療秩序行為的方式進(jìn)行法律歸類并明確其法律責(zé)任。最后，通過(guò)對(duì)現(xiàn)有的國(guó)內(nèi)外醫(yī)患矛盾調(diào)處機(jī)制進(jìn)行探討，力求設(shè)立符合我國(guó)基本國(guó)情與醫(yī)療環(huán)境的醫(yī)患糾紛解決機(jī)制，以預(yù)防擾亂醫(yī)療秩序行為的發(fā)生。 全文分為四部分，主要內(nèi)容如下： 第一部分主要是對(duì)醫(yī)療秩序的定義探討。圍繞法律秩序、醫(yī)療秩序的定義進(jìn)行概述以期能夠嚴(yán)謹(jǐn)?shù)谋硎鰯_亂醫(yī)療秩序行為。通過(guò)對(duì)擾亂行為的特征分析，明確主體及其侵犯的客體。 第二部分主要論述的是擾亂醫(yī)療秩序行為的原因和社會(huì)危害性。將產(chǎn)生的原因大致歸納為四類，明確相關(guān)方過(guò)失。其次將擾亂行為所造成的對(duì)法治發(fā)展和對(duì)和諧醫(yī)患關(guān)系的建設(shè)危害進(jìn)行整體討論。 第三部分主要對(duì)擾亂醫(yī)療秩序行為的類型和責(zé)任分析進(jìn)行討論。將擾亂行為歸納為侵犯人身權(quán)、財(cái)產(chǎn)權(quán)與破壞醫(yī)療機(jī)構(gòu)秩序三類，分別闡述其表現(xiàn)形式與責(zé)任認(rèn)定。 第四部分主要針對(duì)如何防治擾亂醫(yī)療秩序行為的設(shè)想進(jìn)行概述。對(duì)懲治擾亂行為的法制缺陷進(jìn)行論述并提出建議，繼而分析國(guó)內(nèi)外關(guān)于醫(yī)患矛盾的現(xiàn)行處置方式，對(duì)如何預(yù)防擾亂行為的發(fā)生提出法律上的意見(jiàn)、措施。
[Abstract]:In recent years, medical disputes have occurred frequently, the violent behavior of the patients to disrupt the medical order has been increasing, and the degree of malignancy has become more serious. According to the statistics of the Ministry of Health, more than 20000 medical incidents have occurred nationwide in recent years. Nearly 1/3 more incidents have occurred in 2014 than five years ago, with 28 incidents in 2013 and 26 in 2012. In the face of a serious threat to normal medical order, on 30 April 2012, the Ministry of Health and the Ministry of Public Security jointly issued a circular on maintaining the order of medical institutions, putting forward new requirements for strengthening the safety management of medical institutions. In March 2014, the Prime Minister stated in his report on the work of the Government that medical reform with the reform of public hospitals as the main theme must continue. In April 2014, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security and the Ministry of Justice, After in-depth investigation and study, the State Health and Family Planning Commission has extensively solicited opinions and formulated the opinions on maintaining normal Medical order by punishing crimes involving Medical treatment in accordance with the Law, in order to punish crimes involving Medical treatment in accordance with the Law and to maintain normal Medical order. The construction of harmonious doctor-patient relationship provides a strong judicial guarantee. Based on the analysis of the cases of disturbing medical order, this paper clarifies the causes and social harmfulness, classifies the main ways of disturbing medical order and clarifies its legal responsibility. Finally, through the discussion of the existing doctor-patient conflict mediation mechanism at home and abroad, the author tries to set up a doctor-patient dispute resolution mechanism in accordance with the basic conditions and medical environment of our country, in order to prevent the occurrence of disturbing medical order behavior. This paper is divided into four parts. The main contents are as follows: the first part mainly discusses the definition of medical order. The definition of medical order is summarized in order to describe the behavior of disturbing medical order strictly. By analyzing the characteristics of the disturbed behavior, the subject and the object of its violation are defined. The second part mainly discusses the cause of disturbing medical order and social harmfulness. The causes will be roughly divided into four categories, clear related party fault. Secondly, the damage to the development of the rule of law and the construction of harmonious doctor-patient relationship caused by the disturbance behavior is discussed as a whole. The third part mainly discusses the types and responsibilities of the behavior of disturbing medical order. The disturbing behavior is classified as infringing personal rights, property rights and destroying the order of medical institutions. The fourth part is mainly about how to prevent and cure the behavior of disturbing medical order. This paper discusses the legal defects of punishing the disturbance behavior and puts forward some suggestions, and then analyzes the current ways of dealing with the contradiction between doctors and patients at home and abroad, and puts forward some legal opinions and measures on how to prevent the occurrence of the disturbance behavior.
