【摘要】：為了解決煤層氣礦業(yè)權(quán)與煤炭礦業(yè)權(quán)糾紛多發(fā)現(xiàn)狀,以煤層氣和煤炭賦存關(guān)系和煤層氣易燃易爆特點為線索,研究了煤層氣雙重法律規(guī)制和煤層氣礦業(yè)權(quán)瑕疵的具體表現(xiàn),認(rèn)為《煤炭法》及安全生產(chǎn)法律法規(guī)對煤層氣抽采的規(guī)制導(dǎo)致煤層氣礦業(yè)權(quán)人在煤礦基建區(qū)和煤炭開采區(qū)的煤層氣占有權(quán)和開采權(quán)行使受限,使權(quán)力出現(xiàn)瑕疵。瑕疵的救濟可通過行政復(fù)議、行政訴訟方式申請撤銷不當(dāng)?shù)男姓䴖Q定,也可通過自主協(xié)商、行政調(diào)解、行政裁決等方式解決礦業(yè)權(quán)人之間糾紛,或通過民事訴訟途徑要求煤炭礦業(yè)權(quán)人停止侵權(quán)并賠償經(jīng)濟損失。
[Abstract]:In order to solve the current situation of frequent disputes between coalbed methane mining rights and coal mining rights, the relationship between coalbed methane and coal mining rights and the flammable and explosive characteristics of coalbed methane are taken as clues to study the dual legal regulation of coalbed methane and the specific manifestation of defects in mining rights of coalbed methane. It is considered that the regulation of coalbed methane extraction by the Coal Law and the laws and regulations on safe production results in the limitation of the exercise of the right of possession and exploitation of the coalbed methane in the capital construction area and the coal mining area of the coal mine by the owner of the mining right of the coal bed methane, which makes the power appear defective. The remedy of defects may be resolved by administrative reconsideration, administrative litigation, application for rescission of improper administrative decision, or through independent consultation, administrative mediation, administrative adjudication and other means to resolve disputes between mining owners, Or require coal mining owners to stop infringing and compensate for economic losses through civil litigation.
