【摘要】：政府應(yīng)當(dāng)只是作為一個(gè)公益“守夜人”的角色存在于現(xiàn)代社會(huì)中,而不應(yīng)該成為經(jīng)營(yíng)土地的主體,而在我國(guó)由于歷史原因,政府經(jīng)營(yíng)土地又是一個(gè)客觀存在且不容回避的事實(shí),也曾經(jīng)在我國(guó)土地市場(chǎng)化和農(nóng)村城市化過(guò)程中發(fā)揮過(guò)一些有益的作用�，F(xiàn)今,隨著我國(guó)改革開(kāi)放的深入、政府職能的轉(zhuǎn)變,政府經(jīng)營(yíng)土地的弊端日益突出,引起了社會(huì)的廣泛關(guān)注,因此重新構(gòu)建政府在土地經(jīng)營(yíng)中的角色定位已迫在眉睫。 本文首先采取文獻(xiàn)檢索法瀏覽了近幾年相關(guān)方向的學(xué)術(shù)論文與期刊,為本文前期框架理論的形成打下了較為堅(jiān)實(shí)的基礎(chǔ)；其次分析了中國(guó)政府在經(jīng)營(yíng)土地政策中存在的缺陷與不足；最后通過(guò)對(duì)比分析法對(duì)解決我國(guó)土地政策中的問(wèn)題提出了完善構(gòu)想。 本文共分為三部分： 第一部分對(duì)政府經(jīng)營(yíng)土地政策進(jìn)行概述。首先介紹政府經(jīng)營(yíng)土地的涵義,然后探討我國(guó)政府經(jīng)營(yíng)土地形成的法律基礎(chǔ),最后梳理我國(guó)政府經(jīng)營(yíng)土地制度的發(fā)展與演變。 第二部分首先重新定義我國(guó)政府經(jīng)營(yíng)土地的法律關(guān)系,明確在經(jīng)營(yíng)土地的土地征收、土地出讓和征地補(bǔ)償這三個(gè)環(huán)節(jié)中政府都應(yīng)當(dāng)承擔(dān)法律責(zé)任與法律義務(wù)；然后提出我國(guó)政府經(jīng)營(yíng)土地制度中存在三個(gè)方面的問(wèn)題：第一,公共利益問(wèn)題,如何防止地方政府濫用公共利益,以“公共利益”之名,行“濫用公權(quán)”之實(shí)；第二,正當(dāng)程序問(wèn)題；第三,征地補(bǔ)償問(wèn)題。 第三部分主要講政府經(jīng)營(yíng)土地的完善構(gòu)想。首先介紹了國(guó)外政府在土地市場(chǎng)管理方面的經(jīng)驗(yàn),在此基礎(chǔ)上對(duì)政府經(jīng)營(yíng)土地的行為進(jìn)行合理規(guī)制。 本文創(chuàng)新之處在于從法律關(guān)系這一角度對(duì)政府經(jīng)營(yíng)土地進(jìn)行分析,明確政府經(jīng)營(yíng)土地過(guò)程中的主體、客體以及內(nèi)容,通過(guò)確立相關(guān)主體間的權(quán)利和義務(wù),借鑒國(guó)外政府經(jīng)營(yíng)土地的經(jīng)驗(yàn),分析我國(guó)現(xiàn)有政府經(jīng)營(yíng)土地模式的弊端,試圖摸索出一套可以與我國(guó)本土的實(shí)際情況良好配合的土地改革之路。
[Abstract]:The government should only exist as a public welfare "night-watchman" in modern society, and should not become the main body of land management. However, because of historical reasons, it is an objective and unavoidable fact that the government manages land in our country. Also has played some beneficial role in our country land marketization and the rural urbanization process. Nowadays, with the deepening of China's reform and opening up and the transformation of government functions, the drawbacks of government land management have become increasingly prominent, which has aroused widespread concern of the society, so it is urgent to re-establish the role of the government in land management. Firstly, this paper uses the method of literature retrieval to browse the academic papers and periodicals in the related direction in recent years, which lays a solid foundation for the formation of the frame theory in the early stage of this paper. Secondly, it analyzes the defects and shortcomings of the Chinese government in the land management policy, and finally puts forward a perfect conception to solve the problems in the land policy by means of comparative analysis. This paper is divided into three parts: the first part is an overview of the government land policy. This paper first introduces the meaning of government land management, then probes into the legal basis of the formation of government management land, and finally combs the development and evolution of our government land management system. The second part firstly redefines the legal relationship between the government and the land management in our country. It is clear that the government should bear the legal responsibility and the legal obligation in the land expropriation, the land transfer and the land expropriation compensation. Then it points out that there are three problems in the land management system of our country: first, the public interest problem, how to prevent the local government from abusing the public interest, in the name of "public interest", "abusing public power"; second, Due process; third, compensation for land expropriation. The third part mainly talks about the government management land consummation idea. First, the paper introduces the experience of foreign governments in land market management, and on the basis of this, reasonable regulation of government land management behavior is carried out. The innovation of this paper lies in the analysis of the government land management from the angle of legal relationship, the determination of the subject, object and content in the process of government land management, and the establishment of the rights and obligations among the relevant subjects. Based on the experience of foreign governments in land management, this paper analyzes the drawbacks of the existing mode of government land management in China, and tries to find out a set of land reform paths which can be well coordinated with the actual situation of our country.
