【摘要】：目的系統(tǒng)梳理中國(guó)醫(yī)療機(jī)構(gòu)工作場(chǎng)所暴力相關(guān)的法律法規(guī),并提出政策建議。方法以"工作場(chǎng)所暴力""醫(yī)療暴力""醫(yī)療糾紛""醫(yī)患糾紛""醫(yī)療秩序"為關(guān)鍵詞,對(duì)中國(guó)知網(wǎng)法律數(shù)據(jù)庫、萬方法律數(shù)據(jù)庫、北大法意數(shù)據(jù)庫和北大法寶數(shù)據(jù)庫進(jìn)行檢索,收集法律法規(guī)、部門規(guī)章、地方性法規(guī)及政府規(guī)章等相關(guān)檢索結(jié)果并匯總分析。結(jié)果我國(guó)共有8部法律、2部行政法規(guī)、2部部門規(guī)章及15個(gè)省級(jí)地方性法規(guī)規(guī)章規(guī)定了醫(yī)護(hù)人員享有免受工作場(chǎng)所暴力的權(quán)利,構(gòu)成了防治醫(yī)療機(jī)構(gòu)工作場(chǎng)所暴力的法律基礎(chǔ)。2009—2017年國(guó)家衛(wèi)生和計(jì)劃生育委員會(huì)會(huì)同多部門發(fā)布12個(gè)涉及維護(hù)醫(yī)療秩序的文件,從人防、物防和技防三方面強(qiáng)調(diào)了嚴(yán)厲懲治侵害醫(yī)護(hù)人員人身安全的違法犯罪行為。但我國(guó)在防治醫(yī)療機(jī)構(gòu)工作場(chǎng)所暴力的立法方面與國(guó)際比較尚有差距,表現(xiàn)在對(duì)工作場(chǎng)所暴力尚無協(xié)調(diào)一致的定義,無專門法律和配套的技術(shù)標(biāo)準(zhǔn),精神暴力所造成的職業(yè)危害尚未納入法律調(diào)整的范疇和國(guó)家職業(yè)病分類目錄。結(jié)論應(yīng)采取有效措施,開展防治醫(yī)療機(jī)構(gòu)工作場(chǎng)所暴力專門立法工作,加強(qiáng)有關(guān)標(biāo)準(zhǔn)體系的制定、相關(guān)研究與國(guó)際交流等工作。
[Abstract]:Objective to systematically analyze the laws and regulations related to workplace violence in Chinese medical institutions and put forward policy recommendations. Methods based on the keywords of "workplace violence", "medical dispute", "doctor-patient dispute" and "medical order", the databases of law, law of Wanfang, law and Italy of Peking University and Fa Bao of Peking University were searched. Collect and analyze relevant retrieval results of laws and regulations, departmental regulations, local regulations and government regulations. Results A total of 8 laws, 2 administrative regulations, 2 departmental regulations and 15 provincial local laws and regulations stipulated the right of health care workers to be free from violence in the workplace. Constituting the legal basis for the prevention and treatment of workplace violence in medical institutions. 2009-2017 the National Health and Family Planning Commission issued 12 documents related to the maintenance of medical order, in conjunction with the National Commission on Health and Family Planning, from civil air defence, The three aspects of physical prevention and technical prevention emphasize the severe punishment of illegal and criminal acts against the personal safety of medical personnel. However, there is still a gap between our country and the international legislation on the prevention and treatment of workplace violence in medical institutions, as shown by the lack of a coordinated definition of workplace violence, the absence of specific laws and supporting technical standards. The occupational hazards caused by mental violence have not been included in the scope of legal adjustment and the National Classification of Occupational Diseases. Conclusion effective measures should be taken to carry out special legislation on prevention and treatment of workplace violence in medical institutions, to strengthen the establishment of relevant standard system, and to make relevant research and international communication.
