【摘要】：行政獎(jiǎng)勵(lì)救濟(jì)制度的完善對(duì)充分發(fā)揮行政獎(jiǎng)勵(lì)制度的優(yōu)勢(shì)有著重要的作用，行政獎(jiǎng)勵(lì)救濟(jì)的運(yùn)行過程可以概括為：需要救濟(jì)的情形發(fā)生——救濟(jì)方通過救濟(jì)方式作用于被救濟(jì)方——救濟(jì)效果的實(shí)現(xiàn)。遵循行政獎(jiǎng)勵(lì)救濟(jì)發(fā)生的邏輯，首先對(duì)行政獎(jiǎng)勵(lì)過程可能發(fā)生的損害進(jìn)行分析，以此闡明需要進(jìn)行救濟(jì)的情形，其發(fā)生可能基于行政主體的行為，也可能基于被救濟(jì)方的自身處境，且這種自身處境并不是因?yàn)橄嚓P(guān)主體的行為所造成。通過這種分析，確定行政獎(jiǎng)勵(lì)救濟(jì)制度完善的方向和所要實(shí)現(xiàn)的救濟(jì)效果。 在以上基礎(chǔ)上，重點(diǎn)分析行政獎(jiǎng)勵(lì)救濟(jì)方、行政獎(jiǎng)勵(lì)被救濟(jì)方、行政獎(jiǎng)勵(lì)救濟(jì)方式三個(gè)行政獎(jiǎng)勵(lì)救濟(jì)過程中的核心元素的現(xiàn)狀及其完善路徑。在對(duì)行政獎(jiǎng)勵(lì)救濟(jì)方、行政獎(jiǎng)勵(lì)被救濟(jì)方進(jìn)行現(xiàn)狀分析時(shí)，注重其作為行政獎(jiǎng)勵(lì)救濟(jì)方式參與主體的范圍研究，并將其作為一種具備意識(shí)能動(dòng)性的“個(gè)體”，分析其在不基于制度原始缺陷的原因下而產(chǎn)生的意識(shí)、行為的不合理異化，以此提出完善之舉；在對(duì)救濟(jì)方式進(jìn)行分析時(shí)，排除救濟(jì)方式在運(yùn)行過程中的參與主體（行政獎(jiǎng)勵(lì)救濟(jì)方、行政獎(jiǎng)勵(lì)被救濟(jì)方）本身存在的問題進(jìn)行研究，注重方式本身的原始缺陷分析，并將其分為司法救濟(jì)方式和非司法救濟(jì)方式兩種基本類型，逐個(gè)進(jìn)行完善。按照行政獎(jiǎng)勵(lì)救濟(jì)發(fā)生的過程進(jìn)行研究，，有效的拓寬了救濟(jì)模式，順應(yīng)時(shí)代潮流和我國實(shí)際，有利于建立具備現(xiàn)實(shí)可行性的行政獎(jiǎng)勵(lì)救濟(jì)制度。
[Abstract]:The perfection of the administrative reward relief system plays an important role in giving full play to the advantages of the administrative reward system. The operation process of administrative reward relief can be summarized as: the situation where relief is needed-the relief party acts on the relief effect of the relief party through the relief method. Following the logic of administrative reward relief, this paper first analyzes the possible damages in the process of administrative reward, so as to clarify the situation of the need for relief, which may occur on the basis of the behavior of the administrative subject. It may also be based on the relief party's own situation, and this situation is not caused by the behavior of the subject concerned. Through this kind of analysis, determine the administrative reward relief system perfect direction and the relief effect to be realized. On the basis of the above, the paper analyzes the status quo and perfect path of the core elements in the process of administrative reward relief, administrative reward relief party, administrative reward relief party and administrative reward relief mode. When analyzing the present situation of the administrative reward relief party and the administrative reward relief party, the author pays attention to the scope research of the administrative reward relief method and regards it as a kind of conscious initiative "individual". This paper analyzes the consciousness and irrational dissimilation of its behavior which is not based on the original defects of the system, and puts forward some perfect measures. Excluding the problems existing in the main body (administrative reward relief party, administrative reward relief party) in the operation of relief mode, paying attention to the analysis of the original defects of the way itself, And it is divided into judicial relief and non-judicial relief two basic types, one by one to perfect. According to the process of administrative reward relief, it effectively broadens the relief model, conforms to the trend of the times and the reality of our country, and is conducive to the establishment of a realistic and feasible administrative reward relief system.
