【摘要】:行政規(guī)范性文件在司法領(lǐng)域的效力是行政訴訟的核心和關(guān)鍵,人民法院在審查具體行政行為合法性的過程中,必然涉及到對行政規(guī)范性文件的效力適用。這一問題的研究,既有理論意義又有實(shí)踐意義,理論上能豐富行政法學(xué)理論,實(shí)踐中可以為行政訴訟法律適用提供方法。同時(shí)行政規(guī)范性文件在司法領(lǐng)域的效力適用問題的解決,對提高行政法制監(jiān)督水平和行政執(zhí)法水平有重大的現(xiàn)實(shí)意義,對維護(hù)法制統(tǒng)一,建設(shè)社會主義法治國家有深遠(yuǎn)的歷史意義。 在探討行政規(guī)范性文件在司法領(lǐng)域的效力這一問題時(shí),首先界定了行政規(guī)范性文件在司法領(lǐng)域的效力的界定和特征。其次分析了行政規(guī)范性文件在司法領(lǐng)域的效力適用的現(xiàn)狀和存在的問題。 在此分析的基礎(chǔ)上,進(jìn)一步探尋解決行政規(guī)范性文件在司法領(lǐng)域的效力適用問題的思路。首先,通過對法律、法規(guī)和規(guī)章的地位的研究,得出了這樣的結(jié)論:人民法院在行政訴訟的法律適用中,應(yīng)當(dāng)依據(jù)法律、法規(guī)和規(guī)章;而通過對其他行政規(guī)范性文件效力的研究,可以得出這樣的結(jié)論:人民法院在行政訴訟的法律適用中,不能依據(jù)其他行政規(guī)范性文件,而應(yīng)當(dāng)對其進(jìn)行司法審查。其次,通過對法律規(guī)范沖突的原因、類型、現(xiàn)行解決規(guī)則,提出了解決法律沖突問題的途徑,即建立法律規(guī)范沖突的預(yù)防、排除和裁決機(jī)制。 行政規(guī)范性文件在司法領(lǐng)域的效力適用問題的解決,必將有利于推動我國行政訴訟制度的健康發(fā)展,有利于促進(jìn)立法、行政、司法的良性互動,有利于維護(hù)我國社會主義法制的有機(jī)統(tǒng)一,有利于加快依法治國方略的全面實(shí)施。
[Abstract]:The effectiveness of administrative normative documents in the judicial field is the core and key of administrative litigation. In the process of examining the legality of specific administrative acts, the people's court inevitably involves the application of the validity of administrative normative documents. The study of this problem has both theoretical and practical significance, which can enrich the theory of administrative law in theory and provide a method for the application of law in administrative litigation in practice. At the same time, the solution of the validity and application of administrative normative documents in the judicial field is of great practical significance to improve the level of administrative legal supervision and administrative law enforcement, and to maintain the unity of the legal system. Building a socialist country ruled by law has profound historical significance. When discussing the effectiveness of administrative normative documents in the judicial field, this paper first defines the definition and characteristics of the effectiveness of administrative normative documents in the judicial field. Secondly, it analyzes the current situation and existing problems of the application of administrative normative documents in the judicial field. On the basis of this analysis, the author further explores how to solve the problem of the validity of administrative normative documents in the judicial field. First of all, through the study of the status of laws, regulations and rules, this paper draws such a conclusion: the people's court in the application of the law of administrative proceedings, should be based on the law, regulations and rules; Through the study of the effectiveness of other administrative normative documents, we can draw such a conclusion: the people's court in the application of the law of administrative proceedings, can not be based on other administrative normative documents, but should be judicially reviewed. Secondly, by analyzing the causes, types and existing rules of the conflict of laws, the author puts forward the ways to solve the conflicts of laws, that is, to establish the mechanism of prevention, exclusion and adjudication of conflicts of laws and norms. The solution of the application of administrative normative documents in the judicial field will help to promote the healthy development of our administrative litigation system and promote the positive interaction among legislation, administration and judicature. It is conducive to maintaining the organic unity of our socialist legal system and speeding up the comprehensive implementation of the strategy of governing the country according to law.
