【摘要】：《土地復(fù)墾條例》是規(guī)范土地復(fù)墾活動(dòng),加強(qiáng)土地復(fù)墾管理,提高土地利用社會(huì)效益、經(jīng)濟(jì)效益和生態(tài)效益的重要依據(jù)。對(duì)《土地復(fù)墾條例》實(shí)施中作為土地復(fù)墾權(quán)利人之農(nóng)民參與的研究既可推動(dòng)所有的土地復(fù)墾活動(dòng)在土地復(fù)墾法律秩序下,都以有效地利用土地資源、最大限度地增加社會(huì)財(cái)富、實(shí)現(xiàn)自然資源可持續(xù)發(fā)展之目的,又可實(shí)現(xiàn)土地復(fù)墾活動(dòng)在程序上、實(shí)然實(shí)體和應(yīng)然實(shí)體的內(nèi)在價(jià)值的統(tǒng)一,達(dá)致土地復(fù)墾活動(dòng)的最大效益。土地復(fù)墾有著增加耕地面積、提高土地利用效率、推進(jìn)生態(tài)重建和可持續(xù)發(fā)展的重要作用�！锻恋貜�(fù)墾條例》實(shí)施中的農(nóng)民參與問(wèn)題研究是在“落實(shí)最嚴(yán)格的耕地保護(hù)制度和最嚴(yán)格的節(jié)約用地制度”的指導(dǎo)下,對(duì)作為土地復(fù)墾權(quán)利人之農(nóng)民于《土地復(fù)墾條例》的規(guī)范、指引下從事土地復(fù)墾相關(guān)活動(dòng),及其對(duì)《土地復(fù)墾條例》實(shí)施的反作用之研究。《土地復(fù)墾條例》實(shí)施中的農(nóng)民參與問(wèn)題研究由“《土地復(fù)墾條例》實(shí)施”和“農(nóng)民參與”兩個(gè)要素組成�；谕恋貜�(fù)墾權(quán)利人視角研究《土地復(fù)墾條例》實(shí)施中的農(nóng)民參與問(wèn)題,則需要首先就“《土地復(fù)墾條例》及其實(shí)施”和“作為土地復(fù)墾權(quán)利人之農(nóng)民及其參與”的概念厘清、概念整合及相關(guān)農(nóng)民參與《土地復(fù)墾條例》實(shí)施的交互作用展開(kāi)分析,進(jìn)而在其基礎(chǔ)上運(yùn)用實(shí)證分析方法考察作為土地復(fù)墾權(quán)利人之農(nóng)民參與《土地復(fù)墾條例》實(shí)施存在的問(wèn)題,最終探究相關(guān)農(nóng)民參與的完善路徑。通過(guò)對(duì)樣本地區(qū)進(jìn)行訪談式問(wèn)卷調(diào)查,就我國(guó)當(dāng)前《土地復(fù)墾條例》實(shí)施和農(nóng)民參與《土地復(fù)墾條例》實(shí)施所需參與能力、參與空間這兩類社會(huì)事實(shí)之間的關(guān)系展開(kāi)法律實(shí)證分析。一方面,分別就農(nóng)民對(duì)《土地復(fù)墾條例》的認(rèn)知和評(píng)價(jià)、對(duì)參與土地復(fù)墾活動(dòng)的認(rèn)知、農(nóng)民對(duì)理想土地復(fù)墾活動(dòng)的期許進(jìn)行比較分析,進(jìn)而描述作為自變量之《土地復(fù)墾條例》實(shí)施對(duì)農(nóng)民參與土地復(fù)墾活動(dòng)所需參與能力、參與空間的影響結(jié)果;另一方面,基于農(nóng)民對(duì)《土地復(fù)墾條例》及參與土地復(fù)墾活動(dòng)的認(rèn)同和對(duì)《土地復(fù)墾條例》實(shí)施問(wèn)題成因及改善路徑的認(rèn)知,應(yīng)強(qiáng)化農(nóng)民的權(quán)利人意識(shí)、培養(yǎng)農(nóng)民的規(guī)則意識(shí)、推進(jìn)組織化參與程度以實(shí)現(xiàn)農(nóng)民參與的能動(dòng)性;應(yīng)明晰土地復(fù)墾產(chǎn)權(quán)、設(shè)定耕地流轉(zhuǎn)、完善土地復(fù)墾保證金制度以實(shí)現(xiàn)主體利益分配的均衡性;應(yīng)設(shè)定相關(guān)參與目標(biāo)、參與準(zhǔn)則規(guī)范、組織平臺(tái)規(guī)范、責(zé)任規(guī)范以實(shí)現(xiàn)農(nóng)民參與的規(guī)范性,從農(nóng)民的參與能力、參與積極性、參與空間三方面厘清作為因變量之土地復(fù)墾制度未來(lái)的發(fā)展完善方向。
[Abstract]:The regulations on Land Reclamation is an important basis for standardizing land reclamation activities, strengthening land reclamation management, and improving the social, economic and ecological benefits of land use. The study on the participation of farmers as land reclamation right holders in the implementation of the Land Reclamation regulations can not only promote all land reclamation activities in the legal order of land reclamation, but also effectively utilize land resources and increase social wealth to the maximum extent. To realize the purpose of sustainable development of natural resources, and to realize the unification of the intrinsic value of the real entity and the ought entity in the process of land reclamation activities, and to achieve the maximum benefit of the land reclamation activities. Land reclamation can increase the area of cultivated land and improve the efficiency of land use. The important role of promoting ecological reconstruction and sustainable development. The study on farmers' participation in the implementation of Land Reclamation regulations is guided by "implementing the strictest farmland protection system and the strictest land saving system". With regard to the norms of the regulations on Land Reclamation for Farmers who are the owners of Land Reclamation Rights, they shall, under the guidance of the regulations, engage in activities related to land reclamation, The research on the peasant participation in the implementation of the Land Reclamation regulations consists of two elements: "Land Reclamation regulations" and "Farmers' participation". Based on the perspective of land reclamation right holders, it is necessary to clarify the concepts of "Land Reclamation regulations" and "Farmers and their participation as Land Reclamation right holders" in the implementation of Land Reclamation regulations. Conceptual integration and the interaction between farmers' participation in the implementation of the Land Reclamation regulations, On the basis of the empirical analysis method, this paper investigates the problems existing in the implementation of the Land Reclamation regulations as the land reclamation right holders, and finally probes into the perfect path for the relevant farmers to participate in the implementation of the Land Reclamation regulations. Based on an interview questionnaire survey in the sample areas, this paper analyzes the ability of the farmers to participate in the implementation of the Land Reclamation regulations and the farmers' participation in the implementation of the Land Reclamation regulations. The relationship between the two kinds of social facts of participation space is analyzed empirically by law. On the one hand, the cognition and evaluation of farmers to the Land Reclamation regulations, the cognition of participating in land reclamation activities, and the expectations of farmers for ideal land reclamation activities are respectively analyzed. Furthermore, the paper describes the effect of land reclamation regulations as independent variables on farmers' ability to participate in land reclamation activities and their participation space; on the other hand, the impact of the implementation of the regulations on land reclamation on the ability of farmers to participate in land reclamation activities is described. Based on the farmers' recognition of the Land Reclamation regulations and their participation in land reclamation activities, and the understanding of the causes of the problems and the ways to improve the implementation of the Land Reclamation regulations, we should strengthen the farmers' awareness of the right holders and cultivate the farmers' awareness of the rules. Promoting the organized participation degree to realize the active role of farmers' participation; should clear the land reclamation property right, set up the farmland circulation, perfect the land reclamation deposit system to realize the balance of the main body benefit distribution; should set the relevant participation goal, Participation criteria, organizational platform norms, responsibility norms to achieve the norms of farmers' participation, from the farmers' participation ability, participation enthusiasm, participation space to clarify the future development and improvement of land reclamation system as dependent variables.
