【摘要】：生活飲用水衛(wèi)生狀況關(guān)系到每一個(gè)人的身體健康與生命安全,喝上放心、安全、衛(wèi)生的飲用水是每一個(gè)人的基本需求。然而,近年來(lái)生活飲用水污染事件頻頻發(fā)生,導(dǎo)致人們的日常生活生產(chǎn)受到影響,也讓公眾對(duì)于飲用水的衛(wèi)生狀況產(chǎn)生擔(dān)憂。為了減少生活飲用水污染事件的發(fā)生、并提高飲用水水質(zhì),就江蘇省的飲用水衛(wèi)生監(jiān)督管理狀況來(lái)說(shuō),完善相關(guān)法律、法規(guī),健全監(jiān)管制度迫在眉睫。本文首先分析了江蘇省生活飲用水的衛(wèi)生現(xiàn)狀。江蘇省生活飲用水衛(wèi)生狀況總體優(yōu)良,豐富的水資源為江蘇省的生活飲用水提供了基礎(chǔ)性保障,飲用水供水水廠建設(shè)以及管網(wǎng)配備充足,但同時(shí)也存著在水資源分布不均衡、河流污染、水質(zhì)型缺水等情況。江蘇省生活飲用水衛(wèi)生存在著以下幾個(gè)問(wèn)題:環(huán)境污染威脅著水源衛(wèi)生安全、水廠的水質(zhì)合格率亟待提高、生活飲用水輸送環(huán)節(jié)存在衛(wèi)生隱患以及二次供水的污染現(xiàn)象普遍等問(wèn)題。為解決江蘇省生活飲用水衛(wèi)生存在的問(wèn)題,筆者從法律制度層面分析現(xiàn)有衛(wèi)生監(jiān)管制度的缺漏之處。我國(guó)現(xiàn)行生活飲用水制度存在著法律規(guī)定過(guò)于原則、法律規(guī)定之間存在矛盾與沖突以及立法存在疏漏等方面的問(wèn)題。在生活飲用水衛(wèi)生監(jiān)督管理方面,監(jiān)管機(jī)構(gòu)存在職能重疊或交叉、監(jiān)管能力不足等方面的問(wèn)題。在生活飲用水衛(wèi)生監(jiān)管配套措施方面也存在不完善的現(xiàn)象,如:財(cái)政保障不充足、預(yù)警及應(yīng)急處置制度不健全、公眾參與制度的缺失等。對(duì)此,筆者提出法律對(duì)策,制定《江蘇省生活飲用水衛(wèi)生監(jiān)督管理?xiàng)l例》,并健全飲用水衛(wèi)生監(jiān)管配套制度措施,以期對(duì)于改善江蘇省生活飲用水衛(wèi)生狀況有所助力。
[Abstract]:The sanitary condition of drinking water is related to the health and safety of everyone. Drinking safe drinking water is the basic need of everyone. However, the frequent incidents of drinking water pollution in recent years have affected people's daily life production and made the public worried about the sanitation of drinking water. In order to reduce the incidents of drinking water pollution and improve the quality of drinking water, it is urgent to perfect the relevant laws, regulations and supervision system for the sanitary supervision and management of drinking water in Jiangsu Province. This paper first analyzes the sanitary status of drinking water in Jiangsu Province. The sanitary situation of drinking water in Jiangsu Province is good in general. Abundant water resources provide a basic guarantee for drinking water in Jiangsu Province. The construction of drinking water supply and water supply plants and the provision of pipe networks are adequate, but at the same time, the distribution of water resources is not balanced. River pollution, water shortage and so on. The sanitation of drinking water in Jiangsu Province has the following problems: environmental pollution threatens the sanitation and safety of water sources, and the qualified rate of water quality in water plants needs to be improved. There are some problems in drinking water transportation, such as sanitary hidden trouble and pollution of secondary water supply. In order to solve the problems of drinking water sanitation in Jiangsu Province, the author analyzes the deficiencies of the existing health supervision system from the legal system. The present drinking water system of our country has some problems, such as the over-principle of the legal regulation, the contradiction and conflict between the legal provisions and the omission of the legislation, etc. In the aspect of sanitary supervision and management of domestic drinking water, there are some problems such as overlapping or overlapping of functions and insufficient supervision capacity. There are also some imperfect measures in sanitary supervision of drinking water, such as inadequate financial guarantee, imperfect early warning and emergency disposal system, lack of public participation system, and so on. In order to improve the sanitary condition of drinking water in Jiangsu Province, the author puts forward the legal countermeasures, formulates the regulations of Sanitary Supervision and Administration of drinking Water in Jiangsu Province, and perfects the supporting system of drinking Water Sanitation Supervision in Jiangsu Province in order to improve the sanitary condition of drinking water in Jiangsu Province.
